Arguments in Favour<\/u><\/strong><\/span><\/span><\/span><\/p>\n

To avoid long disputes:<\/strong><\/span><\/span><\/span> The real aim of law is neither to punish the one nor reward the other. But a society should not be bothered with disputes for eternity. So the l<\/span><\/span><\/span>aw puts a limit of twelve years for such quarrels and disputes<\/strong><\/span><\/span><\/span> before which the title must be settled.\u00a0<\/span><\/span><\/span><\/li>\n
Land should be put to a judicious use:<\/strong><\/span><\/span><\/span> The concept of adverse possession stems from the idea that land<\/span><\/span><\/span> must not be left vacant<\/strong><\/span><\/span><\/span> but instead, be put to judicious use. Essentially, adverse possession refers to the hostile possession of property, which must be continuous, uninterrupted, and peaceful.<\/span><\/span><\/span>\n
\n
According to the Law Commission, the rationale behind this comes from considerations that the \u201ctitle to land should not long be in doubt\u201d, \u201csociety will benefit from someone making use of land the owner leaves idle,\u201d and \u201cpersons who come to regard the occupant as owner may be protected.\u201d<\/span><\/span><\/span><\/li>\n<\/ul>\n<\/li>\n
Original title holder neglected his rights:<\/strong><\/span><\/span><\/span> The maxim that the law does not help those who sleep over their rights is invoked in support of adverse possession. Simply put, \u201cthe <\/span><\/span><\/span>original title holder who neglected to enforce his rights over the land<\/strong><\/span><\/span><\/span> cannot be permitted to re-enter the land after a long passage of time,\u201d.<\/span><\/span><\/span><\/li>\n<\/ul>\n
Arguments Against<\/u><\/strong><\/span><\/span><\/span><\/p>\n

Harsh for true owner: <\/strong><\/span><\/span><\/span>The law as it exists is extremely harsh for the true owner and a windfall for a dishonest person who has illegally taken possession of the property.<\/span><\/span><\/span>\n
\n
It shows that the l<\/span><\/span><\/span>aw seeks to punish a non-diligent title holder<\/strong><\/span><\/span><\/span> who fails to assert his rights within twelve long years, by denying his claim, but on the converse side the <\/span><\/span><\/span>same law rewards a wrong doer<\/strong><\/span><\/span><\/span> and a trespasser by confirming his title by adverse possession, provided his possession satisfies the stipulated condition.<\/span><\/span><\/span><\/li>\n
SC bench, in its 2008 ruling in <\/span><\/span><\/span>Hemaji Waghaji Jat v. Bhikhabhai Khengarbhai Harijan and Others,<\/strong><\/span><\/span><\/span> while dealing with Article 65 of the Schedule of the Limitation Act, 1963, observed that the law of adverse possession \u201cousts an owner on the basis of inaction within limitation\u201d and is \u201c<\/span><\/span><\/span>irrational, illogical, and wholly disproportionate\u201d.<\/strong><\/span><\/span><\/span><\/li>\n<\/ul>\n<\/li>\n
Avoidable and expensive litigation:<\/strong><\/span><\/span><\/span> True owners have been subjected to, such as \u201cavoidable and expensive litigation\u201d by unscrupulous persons\u201d who are acquainted with fraud, the already overburdened machinery of the courts is further saddled with avoidable work, much to the misery of the litigants.<\/span><\/span><\/span><\/li>\n
Struck off law will not harm anybody: <\/strong><\/span><\/span><\/span>lf the law of adverse possession is struck off from the Limitation Act it<\/span><\/span><\/span> will not hinder anybody\u2019s right<\/strong><\/span><\/span><\/span> nor will it cause any neglect of land resources.<\/span><\/span><\/span><\/li>\n
Promotes false claims:<\/strong><\/span><\/span><\/span> The fact that land prices are skyrocketing in both rural and urban areas defeated the Commission\u2019s argument that land is not put to proper use. In an over-populous country like India where land is scarce, the law of adverse possession only <\/span><\/span><\/span>promotes false claims under the colour of adverse possession <\/strong><\/span><\/span><\/span>which ultimately does not stand judicial scrutiny.<\/span><\/span><\/span><\/li>\n
Different laws for state and private individuals:<\/strong><\/span><\/span><\/span> If in a welfare state and under law, state and common man have same rights and same Acts being applicable, then why is there a different time window for the adverse possession over Government land.\u00a0<\/span><\/span><\/span><\/li>\n<\/ul>\n
Way Ahead<\/u><\/strong><\/span><\/span><\/span><\/p>\n

Compensate the Title owner:<\/strong><\/span><\/span><\/span> If this law is to be retained, according to the wisdom of Parliament then at least the law must require those who adversely possess<\/span><\/span><\/span> land to compensate the title owners <\/strong><\/span><\/span><\/span>according to the prevalent market rate of the land or property in question.\u00a0<\/span><\/span><\/span><\/li>\n
Increase the time frame of possessing the property: <\/strong><\/span><\/span><\/span>Parliament might simply require the adverse possession claimants to possess the property in question<\/span><\/span><\/span> for a period of 30 to 50 years, rather than a mere 12.<\/strong><\/span><\/span><\/span>\u00a0<\/span><\/span><\/span>\n

A longer statutory period would also <\/span><\/span><\/span>decrease the frequency of adverse possession suits<\/strong><\/span><\/span><\/span> and ensure that only those claimants most intimately connected with the land acquire it, while only the <\/span><\/span><\/span>most passive and unprotected owners lose title.<\/strong><\/span><\/span><\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n

Khap Panchayat: <\/strong><\/span><\/span><\/span><\/span>Khap panchayat governs the khap formed by same gotra ( clan) families from several neighbouring villages.It is an assembly of Khap elders.The system is believed to have existed as early as 600 AD.<\/span><\/span><\/span><\/span><\/li>\n

The major function of Khaps today is to settle disputes and ensure that social and religious custom is enforced in their area.<\/span><\/span><\/span><\/li>\n

Khaps do not have a set organisation. Earlier, succession as a Khap president\/leader was hereditary.Now, it is not necessarily the same.<\/span><\/span><\/span><\/li>\n
To preside over a meeting of a particular Khap or a group of Khaps, the chairman is nominated unanimously and on the spot. There are no defined rules to elect the president.<\/span><\/span><\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n
Types of Khaps<\/u><\/strong><\/span><\/span><\/span><\/p>\n

There are nearly 300 main Khaps in north India \u2013 in Haryana, Uttar Pradesh, Delhi,Rajasthan and Uttarakhand.<\/span><\/span><\/span><\/li>\n
Gotra based khaps:<\/strong><\/span><\/span><\/span>Several khaps including Gathwala khap (Malik khap), Dalal khap, Poonia khap, Sangwan khap, Dahiya khap, Sheoran khap, Binain khap (Hisar) and Sherawat khap etc have jurisdiction in the villages dominated by the gotras concerned<\/span><\/span><\/span><\/li>\n
Region based Khaps:<\/strong><\/span><\/span><\/span>These include Meham chaubisi khap, Rohtak Chaurasi khap, Satrol khap, Jharsa 360 khap and Sonipat 360 khap.They have influence ranging from a couple of villages to a few hundred villages.<\/span><\/span><\/span><\/li>\n
Khaps are not affiliated with the formally elected government bodies and are instead concerned with the affairs of the Khap it represents.<\/span><\/span><\/span><\/span><\/li>\n<\/ul>\n

In several rural parts of north India, Khaps have tremendous influence among villagers because of their role in<\/span><\/span><\/span> resolving local social disputes<\/strong><\/span><\/span><\/span> including marital problems, land disputes, and other family matters.<\/span><\/span><\/span><\/li>\n
Khaps can impose a number of penalties, such as social boycotts,monetary fines etc.<\/span><\/span><\/span><\/li>\n
In 2020-21, they had actively participated in the farmer agitation against three contentious farm laws, which were eventually repealed.<\/span><\/span><\/span><\/li>\n<\/ul>\n

Khaps draw power from the<\/span><\/span><\/span> large number of people<\/strong><\/span><\/span><\/span> who are associated with them, by virtue of their gotra or place of residence.<\/span><\/span><\/span><\/li>\n

Criticism<\/u><\/strong><\/span><\/span><\/span><\/p>\n

Over the years they have emerged as <\/span><\/span><\/span><\/span>quasi-judicial bodies<\/strong><\/span><\/span><\/span><\/span> that pronounce harsh punishments based on age-old customs and traditions.<\/span><\/span><\/span><\/span>They have also been accused of committing <\/span><\/span><\/span>honour killings.<\/strong><\/span><\/span><\/span><\/li>\n

Using Algorithms: <\/strong><\/span><\/span><\/span>Narrowing down the right antibacterial chemicals against bacteria can be a<\/span><\/span><\/span> long, difficult process.<\/strong><\/span><\/span><\/span> The concept of AI is based on the <\/span><\/span><\/span>process of machines being given large amounts of data and training themselves on identifying patterns and solutions based on them.<\/strong><\/span><\/span><\/span>\n

Researchers first exposed A. baumannii grown in a lab dish to about 7,500 different chemical compounds, to see which ones could help pause the growth of the bacterium. Then they<\/span><\/span><\/span> fed the structure of each molecule into the machine-learning model.\u00a0<\/strong><\/span><\/span><\/span><\/li>\n
They also told the model whether each structure could prevent bacterial growth or not. This allowed the algorithm to learn<\/span><\/span><\/span> chemical features associated with growth inhibition.<\/strong><\/span><\/span><\/span><\/li>\n<\/ul>\n<\/li>\n
Analysis of Yielded Result:<\/strong><\/span><\/span><\/span> Once the model was trained, the researchers used it to analyse a set of 6,680 compounds. This analysis took less than two hours and yielded a few hundred results.\u00a0<\/span><\/span><\/span>\n

Of these, the researchers chose 240 to test experimentally in the lab, focusing on compounds with structures that were <\/span><\/span><\/span>different from those of existing antibiotics.<\/strong><\/span><\/span><\/span><\/li>\n<\/ul>\n<\/li>\n

A <\/span><\/span><\/span>widespread lack of knowledge about antibiotics<\/strong><\/span><\/span><\/span> means that most patients – rural and urban – are not aware of antibiotic resistance. Even the rich and educated take antibiotics if they fall ill or pressure doctors to prescribe antibiotics.<\/span><\/span><\/span><\/li>\n<\/ul>\n
Preventive Measures<\/u><\/strong><\/span><\/span><\/span><\/p>\n

Some measures people can take include<\/span><\/span><\/span> finishing the treatment course and not sharing antibiotic medications with others<\/strong><\/span><\/span><\/span>\u2014 even if they have the same symptoms.<\/span><\/span><\/span><\/li>\n
Only using antibiotics when necessary:<\/strong><\/span><\/span><\/span> Most doctors <\/span><\/span><\/span>only prescribe <\/strong><\/span><\/span><\/span>antibiotics if the person cannot do without them.<\/span><\/span><\/span><\/li>\n
Using the shortest effective treatment:<\/strong><\/span><\/span><\/span> While it is vital to take all the antibiotics that a doctor prescribes, exactly as instructed, <\/span><\/span><\/span>the doctor will prescribe the shortest possible course.<\/strong><\/span><\/span><\/span><\/li>\n
Not using antibiotics for viral infections: <\/strong><\/span><\/span><\/span>Antibiotics have no effect on illnesses caused by viruses, such as the flu, and us<\/span><\/span><\/span>ing antibiotics incorrectly in this way can contribute to drug resistance.<\/strong><\/span><\/span><\/span><\/li>\n
Experts believe<\/span><\/span><\/span> India needs to invest more<\/strong><\/span><\/span><\/span> in and beef up diagnostic labs, produce more infectious diseases physicians, reduce hospital infections and train doctors on usage of antibiotics based on tests to tackle the rising threat of superbugs. Carbon sequestration: <\/strong><\/span><\/span><\/span>Removing carbon dioxide from the atmosphere and then storing it is known as <\/span><\/span><\/span>carbon sequestration.<\/strong><\/span><\/span><\/span><\/li>\n
Carbon sink<\/strong><\/span><\/span><\/span> is any system that absorbs more carbon than it emits. The main natural carbon sinks are soil, forests and oceans.<\/span><\/span><\/span>\n

To date, no artificial carbon sinks are able to remove carbon from the atmosphere on the scale to fight global warming.<\/span><\/span><\/span><\/li>\n<\/ul>\n<\/li>\n
Carbon offsetting: <\/strong><\/span><\/span><\/span>Another way to pursue carbon neutrality is to <\/span><\/span><\/span>offset emissions<\/strong><\/span><\/span><\/span> made in one sector by reducing them somewhere else.<\/span><\/span><\/span><\/li>\n
This can be done through investment in renewable energy, energy efficiency or other clean, low-carbon technologies.<\/span><\/span><\/span><\/li>\n<\/ul>\n
