In 2017, the<\/span><\/span><\/span> Global Alliance of National Human Rights<\/strong><\/span><\/span><\/span> granted accreditation to the National Human Rights Commission after a year-long deferment; it had raised concerns about the functioning of<\/span><\/span><\/span> India\u2019s statutory human rights body.<\/strong><\/span><\/span><\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n

Why is accreditation important?<\/u><\/strong><\/span><\/span><\/span><\/p>\n

The <\/span><\/span><\/span>Global Alliance of National Human Rights Institutions<\/strong><\/span><\/span><\/span> represents 110 human rights bodies across the world. The accreditation status it gives is based on the <\/span><\/span><\/span>United Nations\u2019 Paris Principles, which was adopted in 1993.<\/strong><\/span><\/span><\/span><\/li>\n
The<\/span><\/span><\/span> Paris Principles<\/strong><\/span><\/span><\/span> lists <\/span><\/span><\/span>six criteria that human rights bodies must adhere to<\/strong><\/span><\/span><\/span> \u2013 mandate and competence, autonomy from government, independence guaranteed by a statute or Constitution, pluralism, adequate resources and adequate powers of investigation.<\/span><\/span><\/span><\/li>\n
Human rights bodies that are fully compliant with these principles are given the<\/span><\/span><\/span> \u201cA\u201d status.<\/strong><\/span><\/span><\/span> In case they are partially compliant, a<\/span><\/span><\/span> \u201cB\u201d status is given.<\/strong><\/span><\/span><\/span> The global alliance reviews the accreditation every five years.\u00a0<\/span><\/span><\/span><\/li>\n
Without the accreditation, the National Human Rights Commission will <\/span><\/span><\/span>not be eligible to represent India at the UN Human Rights Council<\/strong><\/span><\/span><\/span><\/li>\n<\/ul>\n
GANHRI (Global Alliance of National Human Rights Institutions)<\/u><\/strong><\/span><\/span><\/span><\/p>\n

It was formerly known as the <\/span><\/span><\/span>International Coordinating Committee of National Human Rights Institutions (NHRIs<\/strong><\/span><\/span><\/span>), GAHNRI is a global network of NHRIs.<\/span><\/span><\/span><\/li>\n
It is constituted as a<\/span><\/span><\/span> non-profit entity (under Swiss law)<\/strong><\/span><\/span><\/span> and Secretariat support is provided by the Office of the <\/span><\/span><\/span>UN High Commissioner for Human Rights (OHCHR<\/strong><\/span><\/span><\/span>).<\/span><\/span><\/span><\/li>\n
The Sub-Committee on Accreditation (SCA) of the\u00a0 Global Alliance of National Human Rights Institutions (GANHRI) has the mandate to review and analyze accreditation applications and to make recommendations to the GANHRI Bureau on the compliance of applicants with the Paris Principles.<\/span><\/span><\/span><\/li>\n
It coordinates the relationship between NHRIs and the UN human rights system.<\/span><\/span><\/span><\/li>\n<\/ul>\n

The National Human Rights Commission (NHRC) of India was<\/span><\/span><\/span> <\/strong><\/span><\/span><\/span>established on 12 October 1993.<\/em><\/strong><\/span><\/span><\/span><\/li>\n
The statute under which it is established is the Protection of <\/span><\/span><\/span>Human Rights Act (PHRA), 1993<\/em><\/strong><\/span><\/span><\/span> as amended by the <\/strong><\/span><\/span><\/span>2006 Amendment Act.<\/em><\/strong><\/span><\/span><\/span>\n
\n
Hence, it is a<\/span><\/span><\/span> <\/em><\/span><\/span><\/span>Statutory Body.<\/em><\/strong><\/span><\/span><\/span><\/li>\n<\/ul>\n<\/li>\n
It was set up in <\/span><\/span><\/span>conformity with the Paris Principles.<\/em><\/strong><\/span><\/span><\/span><\/li>\n
NHRC has retained its ‘A’ status of accreditation with the <\/span><\/span><\/span>Global Alliance of National Human Rights Institutions (GANHRI)<\/em><\/span><\/span><\/span> for the 4th consecutive term of 5 years.<\/span><\/span><\/span>\n

The NHRC, India got ‘A’ status of accreditation for the first time in 1999 which was retained in 2006, 2011 and 2017 reviews.<\/span><\/span><\/span><\/li>\n<\/ul>\n<\/li>\n
The NHRC is an embodiment of India\u2019s concern for the promotion and protection of human rights.<\/span><\/span><\/span><\/li>\n
The world looks at the NHRC of India as a role model in promoting and monitoring the effective implementation of promotion and protection of human rights.<\/span><\/span><\/span><\/li>\n<\/ul>\n<\/li>\n
Functions of NHRC:<\/strong><\/span><\/span><\/span>\n

The <\/span><\/span><\/span>functions of the Commission<\/em><\/span><\/span><\/span> as stated in <\/span><\/span><\/span>Section 12 of the Act<\/em><\/span><\/span><\/span> include.<\/span><\/span><\/span>\n

Inquiry into complaints of violation of human rights or negligence in the prevention of such violation by a public servant<\/span><\/span><\/span><\/li>\n
Study of treaties and international instruments on human rights<\/span><\/span><\/span><\/li>\n

In most cases, NHRC asks the concerned Central and State Governments to investigate the cases of the violation of Human Rights.<\/span><\/span><\/span><\/li>\n
It has been termed as \u2018India\u2019s teasing illusion\u2019 by Soli Sorabjee (former Attorney-General of India)\u00a0<\/span><\/span><\/span>\n

Concern about \u201cperiod poverty\u201d has fuelled campaigns globally calling for the end of the so-called tampon tax.<\/span><\/span><\/span><\/li>\n<\/ul>\n
Menstrual products<\/strong><\/span><\/span><\/span><\/p>\n

Menstrual products are also called \u2018feminine hygiene\u2019 products.<\/span><\/span><\/span><\/li>\n
These are made to absorb or catch menstrual blood.\u00a0<\/span><\/span><\/span><\/li>\n
A number of different products are available – some are disposable, some are reusable.<\/span><\/span><\/span><\/li>\n

Period poverty<\/u><\/strong><\/span><\/span><\/span><\/p>\n

Period poverty describes the struggle many low-income women and girls face while trying to afford menstrual products.\u00a0<\/span><\/span><\/span><\/li>\n
It also refers to the increased economic vulnerability women and girls face due the financial burden posed by menstrual supplies.\u00a0<\/span><\/span><\/span><\/li>\n<\/ul>\n
Impact of Period poverty<\/strong><\/span><\/span><\/span><\/p>\n

Period poverty does not only affect women and girls in developing countries; it also affects women in wealthy, industrialized countries.\u00a0<\/span><\/span><\/span><\/li>\n
It causes girls to stay home from school and work; Use unhygienic products; and Pushes girls closer toward dangerous coping mechanisms. E.g. in Kenya, some schoolgirls have engaged in transactional sex to pay for menstrual products.<\/span><\/span><\/span><\/li>\n<\/ul>\n
List of human rights undermined by women\u2019s treatment during menstruation:<\/strong><\/span><\/span><\/span><\/p>\n

Right to health:<\/strong><\/span><\/span><\/span> Menstruation stigma prevents women from seeking treatment for menstruation-related disorders or pain<\/span><\/span><\/span><\/li>\n
Right to education: <\/strong><\/span><\/span><\/span>due to school absenteeism and poor educational outcomes.\u00a0<\/span><\/span><\/span><\/li>\n
Right to work\/<\/strong><\/span><\/span><\/span>work absenteeism: They may refrain from taking certain jobs, or they may be forced to forgo working hours and wages.\u00a0<\/span><\/span><\/span><\/li>\n
Right to non-discrimination and gender equality: <\/strong><\/span><\/span><\/span>Stigmas and norms related to menstruation can reinforce discriminatory practices.\u00a0<\/span><\/span><\/span><\/li>\n
Right to water and sanitation: during periods: <\/strong><\/span><\/span><\/span>They also face poor access to safe Water and sanitation facilities, such as bathing facilities, that are private, safe and culturally acceptable<\/span><\/span><\/span><\/li>\n<\/ul>\n
Tampon Tax \/ Tax On Periods<\/u><\/strong><\/span><\/span><\/span><\/p>\n

What it is? <\/strong><\/span><\/span><\/span>“Tampon tax” (or period tax) means menstrual products being subject to value-added tax (VAT) or sales tax.\u00a0<\/span><\/span><\/span><\/li>\n
What it is not?<\/strong><\/span><\/span><\/span> It is not a special tax levied directly on feminine hygiene products.<\/span><\/span><\/span><\/li>\n
Arguments for abolishing it: <\/strong><\/span><\/span><\/span>This will \u2018End Period Poverty\u2019; It is a basic necessity as females use them for about a week each month for about 30 years.<\/span><\/span><\/span><\/li>\n
Why do countries retain it?<\/strong><\/span><\/span><\/span> VAT is an important source of revenue for governments. In countries belonging to the Organisation for Economic Co-operation and Development (OECD), VAT revenue represented 6.7% of their gross domestic product (GDP) in 2020.<\/span><\/span><\/span><\/li>\n<\/ul>\n
Global Initiatives\u00a0<\/u><\/strong><\/span><\/span><\/span><\/p>\n

Since Kenya became the first country to scrap VAT on sanitary pads and tampons in 2004, at least 17 countries have followed suit. Among the latest countries to pass laws to abolish the tampon tax are Mexico, Britain and Namibia.<\/span><\/span><\/span><\/li>\n
Another 10 countries have designated sanitary products as tax-exempt goods or have exempted the tax on imported raw materials used to make them.<\/span><\/span><\/span><\/li>\n
In 2022, Scotland became the first nation to make tampons and sanitary pads free and available at designated public places such as community centres, youth clubs and pharmacies.<\/span><\/span><\/span><\/li>\n
In 2017, Government of India imposed a 12 % tax on sanitary napkins under the new GST regime; this was abolished later on.<\/span><\/span><\/span><\/li>\n<\/ul>\n
Janaushadhi Suvidha<\/u><\/strong><\/span><\/span><\/span><\/p>\n

In 2018, Government of India launched \u2018Janaushadhi Suvidha\u2019.<\/span><\/span><\/span><\/li>\n
It is an Oxo-biodegradable Sanitary Napkin complying with ASTM D-6954 (biodegradability test) standards. \u2018Oxo-biodegradable\u2019 means a special additive is added in the SUVIDHA napkin which makes it biodegradable when it reacts with oxygen after it is used and discarded.<\/span><\/span><\/span><\/li>\n
It has been launched under the <\/span><\/span><\/span>Pradhan Mantri Bhartiya Janaushadhi Pariyojana (PMBJP) by the Union<\/strong><\/span><\/span><\/span> Department of Pharmaceuticals.<\/span><\/span><\/span><\/li>\n<\/ul>\n

The affordable sanitary napkins are available through Janaushadhi Kendras at a minimum price of Rs.1\/-per pad. The market price of the similar Sanitary Napkins is around Rs. 3\/- to Rs. 8\/- per pad.\u00a0\u00a0\u00a0<\/span><\/span><\/span><\/li>\n

What is copyright infringement?<\/u><\/strong><\/span><\/span><\/span><\/p>\n

Copyright infringement is the use or production of copyright-protected material <\/span><\/span><\/span>without the permission of the copyright holder.\u00a0<\/strong><\/span><\/span><\/span><\/li>\n
It means that the rights afforded to the copyright holder, such as the exclusive use of a work for a set period of time, are being <\/span><\/span><\/span>breached by a third party.<\/strong><\/span><\/span><\/span>\u00a0<\/span><\/span><\/span><\/li>\n
Music and movies<\/strong><\/span><\/span><\/span> are two of the most well-known forms of entertainment that suffer from significant amounts of copyright infringement.<\/span><\/span><\/span><\/li>\n<\/ul>\n
To what extent does copyright law protect artists?<\/u><\/strong><\/span><\/span><\/span><\/p>\n

Copyright law protects the work of diverse artists, including photographers, and provides a set of exclusive rights for artists over their creative output.\u00a0<\/span><\/span><\/span><\/li>\n
This includes <\/span><\/span><\/span>controlling the manner<\/strong><\/span><\/span><\/span> in which others reproduce or modify their work.\u00a0<\/span><\/span><\/span><\/li>\n<\/ul>\n
Andy Warhol Foundation for the Visual Arts Inc. versus Goldsmith et al. case<\/u><\/strong><\/span><\/span><\/span><\/p>\n

Lynn Goldsmith photographed the <\/span><\/span><\/span>famous musician Prince in 1981. <\/strong><\/span><\/span><\/span>One of those photos was licensed in 1984 to Vanity Fair magazine for use as an <\/span><\/span><\/span>\u201cartist reference\u201d.<\/strong><\/span><\/span><\/span> Vanity Fair paid Ms. Goldsmith $400 for the licence.<\/span><\/span><\/span><\/li>\n
Vanity Fair hired the celebrated visual artist <\/span><\/span><\/span>Andy Warhol to work on the illustration.<\/strong><\/span><\/span><\/span> It appeared in the magazine with appropriate credits to Ms. Goldsmith. But while the licence had authorised only one illustration, <\/span><\/span><\/span>Mr. Warhol additionally created 13 screen prints and two pencil sketches.<\/strong><\/span><\/span><\/span><\/li>\n
Vanity Fair, approached the Andy Warhol Foundation (AWF) to reuse the 1984 illustration as part of a story on Prince. But when they realised that there were more portraits available, they opted to publish one of them instead. As part of the licence to use it, <\/span><\/span><\/span>they paid $10,000 to AWF,<\/strong><\/span><\/span><\/span> and<\/span><\/span><\/span> nothing to Ms. Goldsmith.<\/strong><\/span><\/span><\/span><\/li>\n
When the AWF realised that Ms. Goldsmith may file a copyright infringement suit, it filed a suit to declare that it had <\/span><\/span><\/span>not committed infringement.<\/strong><\/span><\/span><\/span> Ms. Goldsmith then <\/span><\/span><\/span>counter-sued AWF for copyright infringement.<\/strong><\/span><\/span><\/span><\/li>\n<\/ul>\n
U.S Supreme Court Verdict<\/u><\/strong><\/span><\/span><\/span><\/p>\n

In this particular instance, according to the majority decision, both Ms. Goldsmith\u2019s photos and Mr. Warhol\u2019s adaptations had more or less the <\/span><\/span><\/span>same purpose \u2014 to portray Prince.\u00a0<\/strong><\/span><\/span><\/span><\/li>\n
The majority of judges concluded that if an original work and secondary work have more or less similar purposes and <\/span><\/span><\/span>if the secondary use is of a commercial nature<\/strong><\/span><\/span><\/span>, the first factor may<\/span><\/span><\/span> not favour a fair-use interpretation<\/strong><\/span><\/span><\/span> unless there are other justifications for copying.<\/span><\/span><\/span><\/li>\n<\/ul>\n

The Copyright Act, 1957<\/strong><\/span><\/span><\/span> provides copyright protection in India.\u00a0<\/span><\/span><\/span><\/li>\n
India follows a<\/span><\/span><\/span> hybrid model of exception<\/strong><\/span><\/span><\/span> in which<\/span><\/span><\/span> fair dealing with copyrighted work<\/strong><\/span><\/span><\/span> is exempted for some specific purposes <\/span><\/span><\/span>under Section 52(1)(a) of the Copyright Act 1957.<\/strong><\/span><\/span><\/span> India also has a long list of enumerated exceptions.<\/span><\/span><\/span><\/li>\n

What is a narco test?<\/u><\/strong><\/span><\/span><\/span><\/p>\n

In a \u2018narco\u2019 or narco analysis test, a drug called <\/span><\/span><\/span>sodium pentothal<\/strong><\/span><\/span><\/span> is injected into the body of the accused, which transports them to a hypnotic or sedated state in which their <\/span><\/span><\/span>imagination is neutralised.\u00a0<\/strong><\/span><\/span><\/span><\/li>\n
In this hypnotic state, the accused is understood as being incapable of lying and is expected to divulge information that is true.<\/span><\/span><\/span><\/li>\n
Sodium pentothal, or sodium thiopental, is a fast-acting, short-duration anaesthetic used in larger doses to sedate patients during surgery. It belongs to the barbiturate class of drugs that act on the central nervous system as depressants.<\/span><\/span><\/span><\/li>\n
Because the drug is believed to weaken the subject\u2019s resolve to lie, it is sometimes referred to as a<\/span><\/span><\/span> \u201ctruth serum\u201d<\/strong><\/span><\/span><\/span>.<\/span><\/span><\/span><\/li>\n
However, narco tests must not be confused with polygraph tests, which, although having the same truth-decoding motive, work differently.\u00a0<\/span><\/span><\/span><\/li>\n<\/ul>\n

Rather than injecting drugs into the body, <\/span><\/span><\/span>polygraph tests attach instruments<\/strong><\/span><\/span><\/span> like cardio-cuffs or sensitive electrodes to the suspect and measure variables such as blood pressure, pulse rate, respiration, change in sweat gland activity, blood flow, etc., while the suspect is being questioned.<\/span><\/span><\/span><\/li>\n<\/ul>\n

In the 2010 Supreme Court (SC) ruling in <\/span><\/span><\/span>\u201cSelvi & Ors vs State of Karnataka & Anr\u201d (2010),<\/strong><\/span><\/span><\/span> SC held that no lie detector tests should be administered <\/span><\/span><\/span>\u201cexcept on the basis of consent of the accused\u201d<\/strong><\/span><\/span><\/span>.\u00a0<\/span><\/span><\/span><\/li>\n
Those who volunteer must have access to a<\/span><\/span><\/span> lawyer and have the physical, emotional, and legal implications<\/strong><\/span><\/span><\/span> of the test explained to them by the police and the lawyer.<\/span><\/span><\/span><\/li>\n
The court emphasised that the \u2018Guidelines for the Administration of Polygraph Test on an Accused\u2019, published by the<\/span><\/span><\/span> National Human Rights Commission in 2000,<\/strong><\/span><\/span><\/span> must be strictly followed.\u00a0<\/span><\/span><\/span>\n

Broadly, the guidelines say that such tests cannot be administered without the subject\u2019s consent, which must be obtained before a Magistrate, and that the police cannot conduct them by themselves whenever they find it appropriate.<\/span><\/span><\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n
What is the evidentiary value of such tests?<\/u><\/strong><\/span><\/span><\/span><\/p>\n

While the results of narco-analysis tests <\/span><\/span><\/span>are not considered \u201cconfessions\u201d <\/strong><\/span><\/span><\/span>since those in a drugged-induced state cannot exercise their choice in answering questions put to them, the Supreme Court, through its 2010 ruling, clarified that <\/span><\/span><\/span>\u201cany information or material that is subsequently discovered with the help of voluntary administered test results can be admitted, <\/strong><\/span><\/span><\/span>in accordance with Section 27 of the Evidence Act, 1872.\u201d<\/span><\/span><\/span><\/li>\n
Thus, if an accused reveals the location of, say, a physical piece of evidence (something like a murder weapon) in the course of the narco test and the police later find that specific piece of evidence at that location, the statement of the accused will not be treated as evidence, but the <\/span><\/span><\/span>physical evidence will be valid.<\/strong><\/span><\/span><\/span><\/li>\n<\/ul>\n
