the Maharashtra Prison Department has been dismissed from service for violating the <\/span><\/span><\/span><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\"><strong>Maharashtra Civil Services (Declaration of Small Family) Rules, 2005<\/strong><\/span><\/span><\/span><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\">.<\/span><\/span><\/span><\/p>\n<p><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\"><strong><u>About the Maharashtra Rules<\/u><\/strong><\/span><\/span><\/span><\/p>\n<ul>\n<li style=\"list-style-type: disc;\"><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\">The Rules define a <\/span><\/span><\/span><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\"><strong>small family<\/strong><\/span><\/span><\/span><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\"> as <\/span><\/span><\/span><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\"><strong>wife, husband and two children<\/strong><\/span><\/span><\/span><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\"> and stipulate that a person is not eligible for a job with Maharashtra Government if he or she has more than two children after 2005.<\/span><\/span><\/span>\n<ul>\n<li style=\"list-style-type: circle;\"><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\">However, the definition of child under these rules <\/span><\/span><\/span><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\"><strong>does not include adopted children<\/strong><\/span><\/span><\/span><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\">.<\/span><\/span><\/span><\/li>\n<\/ul>\n<\/li>\n<li style=\"list-style-type: disc;\"><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\">The set of norms came<\/span><\/span><\/span><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\"><strong> into force in Maharashtra in March 2005<\/strong><\/span><\/span><\/span><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\"> and mandated filing a small family declaration at the time of applying for a government job.<\/span><\/span><\/span><\/li>\n<li style=\"list-style-type: disc;\"><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\">The rules make the Small Family norm an <\/span><\/span><\/span><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\"><strong>additional essential requirement <\/strong><\/span><\/span><\/span><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\">for Groups A, B, C, D of Maharashtra government employees.<\/span><\/span><\/span><\/li>\n<li style=\"list-style-type: disc;\"><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\">The rules also<\/span><\/span><\/span><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\"><strong> empower the state government to give relaxation<\/strong><\/span><\/span><\/span><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\"> in \u2018just and reasonable\u2019 manner and mandates recording such reasons.<\/span><\/span><\/span><\/li>\n<li style=\"list-style-type: disc;\"><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\"><strong>Exemptions<\/strong><\/span><\/span><\/span>\n<ul>\n<li style=\"list-style-type: circle;\"><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\">A person having more than two children on the date commencement of the rule (28<\/span><\/span><\/span><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\"><sup>th<\/sup><\/span><\/span><\/span><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\"> March 2005) shall not be disqualified for appointment under these provisions so long as the number of children on the date of such commencement does not increase.<\/span><\/span><\/span><\/li>\n<li style=\"list-style-type: circle;\"><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\">Also, provided that one or more than one children are born in a single delivery within an year of the commencement, shall not be considered for the disqualification of the rules.<\/span><\/span><\/span><\/li>\n<\/ul>\n<\/li>\n<li style=\"list-style-type: disc;\"><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\">The <\/span><\/span><\/span><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\"><strong>Maharashtra Zilla Parishads And Panchayat Samitis Act <\/strong><\/span><\/span><\/span><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\">disqualifies people who have more than two children from contesting local body elections.<\/span><\/span><\/span><\/li>\n<li style=\"list-style-type: disc;\"><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\">It is <\/span><\/span><\/span><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\"><strong>one of the few states in India which have a \u2018two children\u2019 policy<\/strong><\/span><\/span><\/span><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\"> for appointment in government jobs or even for the elections of some local government bodies.<\/span><\/span><\/span><\/li>\n<\/ul>\n<p><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\"><strong><u>Two Child Policy in India<\/u><\/strong><\/span><\/span><\/span><\/p>\n<ul>\n<li style=\"list-style-type: disc;\"><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\">While there is<\/span><\/span><\/span><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\"><strong> no national policy<\/strong><\/span><\/span><\/span><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\"> mandating two children per family <\/span><\/span><\/span><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\"><strong>yet<\/strong><\/span><\/span><\/span><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\">, the Union Government has from time to time introduced the Promotion of Two Child Norm Bill.<\/span><\/span><\/span><\/li>\n<li style=\"list-style-type: disc;\"><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\">In <\/span><\/span><\/span><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\"><strong>February 2020<\/strong><\/span><\/span><\/span><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\">, a <\/span><\/span><\/span><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\"><strong>Private Member\u2019s Constitution Amendment Bill was introduced<\/strong><\/span><\/span><\/span><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\"> in the Rajya Sabha with regard to the family size.<\/span><\/span><\/span>\n<ul>\n<li style=\"list-style-type: circle;\"><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\">It proposed that a new provision,<\/span><\/span><\/span><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\"><strong> Article 47A <\/strong><\/span><\/span><\/span><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\">(Duty of the State to promote small family norm) should be added in <\/span><\/span><\/span><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\"><strong>Part IV of the Constitution<\/strong><\/span><\/span><\/span><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\">, which deals with the <\/span><\/span><\/span><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\"><strong>Directive Principles of the State Policy <\/strong><\/span><\/span><\/span><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\">(DPSP).<\/span><\/span><\/span>\n<ul>\n<li style=\"list-style-type: square;\"><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\">In 2002, the <\/span><\/span><\/span><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\"><strong>National Commission to Review the Working of the Constitution<\/strong><\/span><\/span><\/span> <span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\"><strong>also recommended<\/strong><\/span><\/span><\/span><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\"> inserting Article 47A into the Constitution <\/span><\/span><\/span><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\"><strong>to control population explosion<\/strong><\/span><\/span><\/span><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\">.<\/span><\/span><\/span><\/li>\n<\/ul>\n<\/li>\n<li style=\"list-style-type: circle;\"><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\">It also <\/span><\/span><\/span><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\"><strong>offered incentives<\/strong><\/span><\/span><\/span><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\"> in taxes, employment, education, priority in social benefit schemes, etc on compelling the norms.<\/span><\/span><\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<div style=\"margin-left: 15px;\">\n<table
