{"id":14880,"date":"2021-04-20T00:00:00","date_gmt":"2021-04-20T00:00:00","guid":{"rendered":"https:\/\/www.nextias.com\/current_affairs\/uncategorized\/20-04-2021\/amendment-proposals-to-pca-act\/"},"modified":"2021-04-20T00:00:00","modified_gmt":"2021-04-20T00:00:00","slug":"amendment-proposals-to-pca-act","status":"publish","type":"post","link":"https:\/\/www.nextias.com\/ca\/current-affairs\/20-04-2021\/amendment-proposals-to-pca-act","title":{"rendered":"Amendment Proposals to PCA Act"},"content":{"rendered":"<p><strong>In News<\/strong><\/p>\n<p>Recently, the<strong> Department of Animal Husbandry and Dairying<\/strong>, under the <strong>Ministry of Fisheries, Animal Husbandry and Dairying, <\/strong>has held a webinar with various stakeholders to <strong>give and seek suggestions<\/strong> on<strong> amendments<\/strong> to the <strong>Prevention of Cruelty to Animals (PCA) Act, 1960<\/strong>.<\/p>\n<p><strong>About PCA Act<\/strong><\/p>\n<ul>\n<li>It intends to p<strong>revent the infliction of unnecessary pain or suffering<\/strong> on animals.<\/li>\n<li>It <strong>defines <\/strong>animals and different forms of animal and <strong>provides for punishments <\/strong>for causing cruelty and suffering to them.<\/li>\n<li>It also provides a set of<strong> guidelines relating to experimentation<\/strong> on animals for scientific purposes and provisions for <strong>exhibition of the performing animals<\/strong> and <strong>offences <\/strong>against them.<\/li>\n<li>Under its <strong>Section 4<\/strong>, the <strong>Animal Welfare Board of India <\/strong>(AWBI) was established in 1962.\n<ul>\n<li>AWBI is a <strong>statutory advisory body<\/strong> on animal welfare laws and promotes animal welfare in the country.<\/li>\n<li><strong>Functions: <\/strong>Ensure that animal welfare laws in the country are diligently followed, provide grants to Animal Welfare Organizations and advise the Government on animal welfare issues.<\/li>\n<li>The Board consists of <strong>28 members<\/strong> and the <strong>term of office<\/strong> of members is for a period of<strong> 3 years<\/strong>.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p><strong>Suggestions by the Department<\/strong><\/p>\n<ul>\n<li>Addition of a stringent new section that <strong>addresses the killing of animals<\/strong> and \u201c<strong>gruesome cruelty<\/strong>\u201d towards them. Its proposed new section has the following provisions-\n<ul>\n<li><strong>Section 11 (A): Gruesome cruelty or life-threatening cruelt<\/strong>y against animals, for which the <strong>penalty <\/strong>is<strong> <\/strong>Rs. 50,000 per animal or the cost of the animal as determined by a jurisdictional veterinarian. This carries <strong>imprisonment <\/strong>of one year which may extend to three years or both.<\/li>\n<li><strong>Section 11 (B):<\/strong> <strong>Killing <\/strong>of an animal for which the <strong>penalty <\/strong>is Rs. 75,000 per animal or three times the cost of the animal as determined by the jurisdictional veterinarian, whichever is more, with <strong>imprisonment <\/strong>of three years which may extend to five years or both.<\/li>\n<li><strong>Section 11 (C):<\/strong> <strong>Exceptions<\/strong>,<strong> to section 11 (B)<\/strong> killing of an animal: i) accident ii) in defence of self or property (iii) by an act of god or war (iv) any other unforeseen circumstance outside the control of any person in general.\n<ul>\n<li>Section 11 (C) has been <strong>criticised for being ambiguous<\/strong> and <strong>could be used to create loopholes<\/strong> that an accused might slip through in a cruelty case.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<ul>\n<li><strong>Hike the penalty for first-time offender<\/strong>s from the current \u201cminimum of Rs. 10 to maximum of Rs. 50\u201d to \u201cnot less than Rs. 750 extended up to Rs 3,750 per animal\u201d.\n<ul>\n<li>The new penalty for first-time offences have been <strong>calculated as per the inflation rate<\/strong>.<\/li>\n<li>There have been <strong>mixed reactions <\/strong>to this and some<strong> sought higher penalty <\/strong>between Rs. 1,000 and Rs. 5,000.<\/li>\n<\/ul>\n<\/li>\n<li>Under <strong>Section 12<\/strong>, dealing with the <strong>practice of doom dev <\/strong>(the process of blowing air into a cow\u2019s vagina to induce production of more milk) or the<strong> injection of any substance to improve lactation<\/strong>, the draft proposes Rs. 75,000 as the penalty with imprisonment of three years which may be extended to five.\n<ul>\n<li>The current penalty is Rs. 1,000, two years in prison or both.<\/li>\n<\/ul>\n<\/li>\n<li><strong>Increase the limitation of prosecution under the PCA Act<\/strong> from three months to two years.<\/li>\n<li><strong>New chapter for the formation of state animal welfare boards<\/strong>.<\/li>\n<\/ul>\n<p><strong>Suggestions by Stakeholder<\/strong><\/p>\n<ul>\n<li>Make the<strong> sections for animal cruelty cognizable<\/strong>, as well as higher penalty and quantum of sentence.<\/li>\n<li>Provisions to <strong>ensure police action<\/strong> according to law, stating that in many cases, police refuse to register FIRs.<\/li>\n<li>On the issue of <strong>speciesism<\/strong>, they demanded that <strong>all animals must have the same rights<\/strong>, including cows and chickens.<\/li>\n<li>Need for a <strong>dog bite protocol<\/strong> (procedure of attending a person bitten by a dog) was also brought up, as well as <strong>protection for animal feeders<\/strong>.<\/li>\n<li>Some emphasised the importance of<strong> incorporating feedback from farmers<\/strong>, who use animals in traditional practices.<\/li>\n<\/ul>\n<p>Source: <a href=\"https:\/\/indianexpress.com\/article\/india\/proposal-to-amend-animal-cruelty-act-strict-measures-suggested-7280788\/\" target=\"_blank\" rel=\"noopener\">IE<\/a><\/p>\n","protected":false},"excerpt":{"rendered":"<p>In News Recently, the Department of Animal Husbandry and Dairying, under the Ministry of Fisheries, Animal Husbandry and Dairying, has held a webinar with various stakeholders to give and seek suggestions on amendments to the Prevention of Cruelty to Animals (PCA) Act, 1960.
