{"id":14618,"date":"2021-04-01T00:00:00","date_gmt":"2021-04-01T00:00:00","guid":{"rendered":"https:\/\/www.nextias.com\/current_affairs\/uncategorized\/01-04-2021\/article-244-a\/"},"modified":"2021-04-01T00:00:00","modified_gmt":"2021-04-01T00:00:00","slug":"article-244-a","status":"publish","type":"post","link":"https:\/\/www.nextias.com\/ca\/current-affairs\/01-04-2021\/article-244-a","title":{"rendered":"Article 244 (A)"},"content":{"rendered":"<p><strong>News<\/strong><\/p>\n<p>The Congress leader Rahul Gandhi promised to<strong> implement Article 244 (A)<\/strong> of the <strong>Constitution <\/strong>to <strong>safeguard the interests of the people<\/strong> in Assam\u2019s <strong>tribal-majority districts. <\/strong><\/p>\n<p><strong>Background <\/strong><\/p>\n<ul>\n<li>In the 1950s, a<strong> demand for a separate hill state<\/strong> arose around certain sections of the <strong>tribal population of undivided Assam<\/strong>.<\/li>\n<li>In 1960, various political parties of the hill areas merged to form the All Party Hill Leaders Conference, demanding a separate state.\n<ul>\n<li>\u00a0After prolonged agitations, Meghalaya gained<strong> statehood in 1972<\/strong>.<\/li>\n<\/ul>\n<\/li>\n<li>The leaders of the <strong>Karbi Anglong and North Cachar Hill<\/strong>s were also part of this movement.\n<ul>\n<li>They were given the option to stay in Assam or join Meghalaya.<\/li>\n<\/ul>\n<\/li>\n<li>They stayed back as the then Congress government promised more powers, including <strong>Article 244 (A).<\/strong><\/li>\n<li>Since then, there has been a<strong> demand for its implementation.<\/strong><\/li>\n<li>In the 1980s, this demand took the <strong>form of a movement<\/strong> with a number of <strong>Karbi groups resorting to violence<\/strong>.\n<ul>\n<li>\u00a0It soon became an armed separatist insurgency demanding full statehood.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<ul>\n<li>In January, a group of BJP legislators from<strong> Assam <\/strong>submitted a memorandum to the Centre seeking the <strong>implementation of Article 244 (A).<\/strong><\/li>\n<\/ul>\n<p><strong>About Article 244 (A)<\/strong><\/p>\n<ul>\n<li>The Congress government in <strong>1969 had inserted article 244(A)<\/strong> in the Constitution to enact a law for constituting an<strong> autonomous State<\/strong> within the <strong>State of Assam<\/strong> and also to provide the<strong> autonomous State with a Legislature<\/strong>, <strong>Council of Ministers<\/strong> or both with such powers and functions as may be <strong>defined by that law. <\/strong><\/li>\n<li>The <strong>22nd Amendment<\/strong>, amended <strong>article 275 <\/strong>in regard to <strong>sums and grants payable<\/strong> to the <strong>autonomous State<\/strong> on and from its <strong>formation under article 244A.<\/strong><\/li>\n<\/ul>\n<p><strong>How is it different from the Sixth Schedule of the Constitution?<\/strong><\/p>\n<ul>\n<li>The <strong>Sixth Schedule<\/strong> of the Constitution \u2014 <strong>Articles 244(2) and 275(1)<\/strong> \u2014 is a <strong>special provision<\/strong> that <strong>allows for greater political autonomy<\/strong> and <strong>decentralised governance<\/strong> in <strong>certain tribal areas<\/strong> of the <strong>Northeast through autonomous councils<\/strong> that are <strong>administered by elected representatives.<\/strong><\/li>\n<li>\u00a0In Assam, the hill districts of <strong>Dima Hasao, Karbi Anglong <\/strong>and <strong>West Karbi and the Bodo Territorial Region<\/strong> are under this provision.<\/li>\n<li><strong>Article 244(A)<\/strong> accounts for more<strong> autonomous powers<\/strong> to <strong>tribal areas. <\/strong><\/li>\n<li>According to Uttam Bathari, who teaches history at Gauhati University, among these the most important power is the <strong>control over law and order.<\/strong>\n<ul>\n<li>In Autonomous Councils under the Sixth Schedule, they do not have jurisdiction of law and order.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p><a href=\"https:\/\/indianexpress.com\/article\/explained\/article-244-a-its-relevance-for-assam-hill-tribes-and-the-politics-7252324\/\" target=\"_blank\" rel=\"noopener\">Source :IE<\/a><\/p>\n<p>\u00a0<\/p>\n","protected":false},"excerpt":{"rendered":"<p>News The Congress leader Rahul Gandhi promised to implement Article 244 (A) of the Constitution to safeguard the interests of the people in Assam\u2019s tribal-majority districts.
