{"id":14586,"date":"2021-03-30T00:00:00","date_gmt":"2021-03-30T00:00:00","guid":{"rendered":"https:\/\/www.nextias.com\/current_affairs\/uncategorized\/30-03-2021\/meeting-of-permanent-indus-commission\/"},"modified":"2021-03-30T00:00:00","modified_gmt":"2021-03-30T00:00:00","slug":"meeting-of-permanent-indus-commission","status":"publish","type":"post","link":"https:\/\/www.nextias.com\/ca\/current-affairs\/30-03-2021\/meeting-of-permanent-indus-commission","title":{"rendered":"Meeting of Permanent Indus Commission"},"content":{"rendered":"<p><strong>In News<\/strong><\/p>\n<p>Recently, the <strong>annual meeting<\/strong> (116th) of the <strong>Permanent Indus Commission<\/strong> (PIC) comprising Indus Commissioners of India and Pakistan has been held in <strong>New Delhi<\/strong>.<\/p>\n<ul>\n<li>Under the provisions of the <strong>Indus Waters Treaty<\/strong> (IWT) <strong>1960<\/strong>, the two Commissioners are required to <strong>meet at least once every year<\/strong>, <strong>alternately in India and Pakistan<\/strong>.<\/li>\n<\/ul>\n<p><strong>Highlights of the Meeting<\/strong><\/p>\n<ul>\n<li>Discussions continued on designs of <strong>two Indian projects<\/strong>, namely, <strong>Pakal Dul <\/strong>and <strong>Lower Kalnai<\/strong>.\n<ul>\n<li>India is building the <strong>Pakal Dul Hydro Electric Project<\/strong> (<strong>1,000 MW<\/strong>) on river <strong>Marusudar<\/strong>, a tributary of the Chenab. The project is located in the <strong>Kishtwar <\/strong>district of Jammu and Kashmir (J&#038;K).<\/li>\n<li>The second project, <strong>Lower Kalnai Hydro Electric Power Project <\/strong>(<strong>48 MW<\/strong>) is being developed on the <strong>Chenab<\/strong> in <strong>Doda <\/strong>districts of J&#038;K.<\/li>\n<\/ul>\n<\/li>\n<li><strong>Pakistan raised objections<\/strong> to the designs of these plants and <strong>India<\/strong> held that these are <strong>fully compliant with the provisions of the Treaty<\/strong> and also provided technical data in support of its position.<\/li>\n<li>Pakistan requested India for <strong>sharing information on the design of other Indian hydropower projects<\/strong> being planned to be developed. <strong>India assured<\/strong> that the information will be<strong> supplied when required to be<\/strong>.<\/li>\n<li>Both the Commissioners reaffirmed their<strong> cordial commitment to interact more frequently <\/strong>in an attempt to resolve the issues by bilateral discussions under the Treaty.<\/li>\n<li>The<strong> 2020 meeting<\/strong> <strong>could not be held <\/strong>due to restrictions induced by the prevailing <strong>Covid-19 pandemic<\/strong> and the <strong>115th meeting<\/strong> of the PIC was held in<strong> Lahore, Pakistan<\/strong> in <strong>August 2018<\/strong><\/li>\n<\/ul>\n<p><strong>Significance<\/strong><\/p>\n<ul>\n<li>The meeting was held <strong>after a gap of more than two-and-a-half years<\/strong>, a period that witnessed the <strong>Pulwama attack<\/strong> (February 2019), <strong>Balakot airstrike<\/strong> (February 2019) and <strong>scrapping of Article 370 <\/strong>(August 2019).\n<ul>\n<li>In 2019, the erstwhile <strong>state of J&#038;K was bifurcated<\/strong> into Union Territories of Ladakh and J&#038;K.<\/li>\n<li>India has since <strong>cleared several hydropower projects<\/strong> for the region.\n<ul>\n<li>Of these, Darbuk Shyok (19 MW), Shankoo (18.5 MW), Nimu Chilling (24 MW), Rongdo (12 MW), Ratan Nag (10.5 MW) are in <strong>Leh <\/strong>(Ladakh).<\/li>\n<li>Mangdum Sangra (19 MW), Kargil Hunderman (25 MW) and Tamasha (12 MW) are <strong>Kargil <\/strong>(Ladakh).<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<\/li>\n<li>It is <strong>seen as a positive step<\/strong> after both countries agreed to strictly observe all agreements on the<strong> 2003 ceasefire<\/strong> along the <strong>Line of Control<\/strong> (LoC) and other sectors in <strong>February 2021<\/strong>.\n<ul>\n<li>It was their <strong>first joint statement <\/strong>by the Indian and Pakistani militaries <strong>in over eight years<\/strong>.<\/li>\n<\/ul>\n<\/li>\n<li>The meeting coincided with the<strong> National Day of Pakistan<\/strong> (<strong>23rd March<\/strong>).\n<ul>\n<li>The day commemorates the passage of the <strong>Lahore Resolution <\/strong>on <strong>23rd March 1940<\/strong> in which the Muslim leaders of the sub-continent set the agenda of a separate homeland for Muslims.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<table border=\"1\" cellspacing=\"0\" style=\"width:735px\">\n<tbody>\n<tr>\n<td style=\"background-color:#fff2cc; height:37.25pt; width:468.0pt\">\n<p><strong>Lahore Session<\/strong><\/p>\n<ul>\n<li>On <strong>23rd March 1940<\/strong>, A.K. Fazul Haq, the Chief Minister of Bengal, moved the Resolution, Its key provisions are\n<ul>\n<li>The<strong> All-India Muslim League<\/strong> reiterated that the<strong> scheme of Federation <\/strong>embodied in the <strong>Government of India Act, 1935<\/strong> was <strong>unacceptable <\/strong>to Muslim India.<\/li>\n<li>Muslims will only accept it if geographically contiguous units with Muslim majorities from the <strong>North-Western and Eastern Zones<\/strong> of India are demarcated and grouped to constitute \u2018<strong>Independent States<\/strong>\u2019 in which the constituent units shall be <strong>autonomous and sovereign<\/strong>.<\/li>\n<li>Also, there will be<strong> adequate, effective and mandatory safeguards<\/strong> in the <strong>constitution <\/strong>to protect their various rights.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<p><strong>Indus Waters Treaty, 1960<\/strong><\/p>\n<ul>\n<li>It was signed between <strong>then Prime Minister Jawaharlal Nehru<\/strong> and<strong> former Pakistan President Ayub Khan<\/strong> on 19th September 1960.<\/li>\n<li>It sets out a <strong>mechanism for cooperation and information exchange<\/strong> between the two countries regarding their <strong>use of the rivers<\/strong>.<\/li>\n<li>According to provisions of the Treaty,\n<ul>\n<li>The water of the <strong>eastern rivers<\/strong> (<strong>Sutlej<\/strong>, <strong>Beas<\/strong>, and <strong>Ravi<\/strong>) amounting to around 33 million acre-feet (MAF) annually is allocated to<strong> India for unrestricted use<\/strong>.<\/li>\n<li>The water of<strong> western rivers<\/strong> (<strong>Indus<\/strong>, <strong>Jhelum<\/strong>, and <strong>Chenab<\/strong>) amounting to around 135 MAF annually is allocated largely to <strong>Pakistan<\/strong>.<\/li>\n<\/ul>\n<\/li>\n<li>Under the treaty, <strong>India<\/strong> has been given the<strong> right to generate hydroelectricity<\/strong> through run of the river projects<strong> on the western rivers<\/strong> <strong>subject to specific criteria for design and operation<\/strong>. It is allowed to <strong>use 20% water<\/strong> of the western rivers for irrigation, power generation and transport purposes.<\/li>\n<li>It also gives <strong>Pakistan the right to raise concerns <\/strong>on the design of Indian hydroelectric projects on western rivers.<\/li>\n<li>The Treaty was <strong>brokered by the World Bank<\/strong> and is <strong>one of the most durable agreements<\/strong> between both nations and has <strong>survived several wars and disruptions<\/strong> in bilateral relations over the decades.<\/li>\n<li>The\u00a0 <strong>Permanent Indus Commission <\/strong>(<strong>PIC) <\/strong>was set up under the Treaty with the following <strong>functions:<\/strong>\n<ul>\n<li>Study and report on any problem relating to the development of river waters.<\/li>\n<li>Solve water sharing disputes.<\/li>\n<li>Arrange technical visits to projects sites.<\/li>\n<li>Undertake a general tour of inspection of the Rivers for ascertaining the facts, once in every five years.<\/li>\n<\/ul>\n<\/li>\n<li><strong>Concerns Highlighted<\/strong>\n<ul>\n<li>Internationally, the Treaty is<strong> seen as one of the most successful cases of conflict resolution<\/strong> but between the two countries, it has seeded <strong>dissatisfaction and conflicts regarding its interpretation and implementation<\/strong>.<\/li>\n<li>The treaty is<strong> highly technical <\/strong>leading to <strong>far-ranging divergences between the two countries in terms of interpretations<\/strong>.\n<ul>\n<li>For example, the treaty says that storage systems can be built but to a limited extent.
