{"id":14528,"date":"2021-03-24T00:00:00","date_gmt":"2021-03-24T00:00:00","guid":{"rendered":"https:\/\/www.nextias.com\/current_affairs\/uncategorized\/24-03-2021\/plea-in-supreme-court-for-wrongful-prosecution-2\/"},"modified":"2021-03-24T00:00:00","modified_gmt":"2021-03-24T00:00:00","slug":"plea-in-supreme-court-for-wrongful-prosecution-2","status":"publish","type":"post","link":"https:\/\/www.nextias.com\/ca\/current-affairs\/24-03-2021\/plea-in-supreme-court-for-wrongful-prosecution-2","title":{"rendered":"Plea in Supreme Court for Wrongful Prosecution"},"content":{"rendered":"<p><strong>In News<\/strong><\/p>\n<p>A petition has been filed in the Supreme Court highlighting the need for the government to frame guidelines for compensating victims of wrongful prosecution by the police or authorities.<\/p>\n<p><strong>Key Highlights <\/strong><\/p>\n<ul>\n<li>A plea has been filed before the Supreme Court seeking directions to the Centre to frame guidelines for compensation to victims of Wrongful Prosecution and implements the r<strong>ecommendations of Law Commission Report No-277 on Miscarriage of Justice in 2018.<\/strong><\/li>\n<li>It has further urged the Court to use its plenary constitutional power to frame the <strong>guidelines<\/strong> for <strong>compensation to victims of wrongful prosecution<\/strong>s and direct the Centre and States to implement them till the recommendations of the <strong>Law Commission are implemented religiously.<\/strong><\/li>\n<li>The petition has stated that the absence of an effective statutory or legal scheme for providing a <strong>mandatory compensatory scheme<\/strong> to victims of<strong> wrongful malicious<\/strong> prosecutions and <strong>incarceration of innocents<\/strong>, infringes fundamental rights guaranteed under<strong> Article 14 and 21 of the constitution.<\/strong><\/li>\n<li>The Commission had prepared the report on the basis of a Delhi High Court order in the Babloo Chauhan case in November 2017 to undertake a \u201ccomprehensive examination of the issue of relief and rehabilitation to victims of wrongful prosecution and incarceration\u201d.<\/li>\n<\/ul>\n<table border=\"1\" cellspacing=\"0\" style=\"width:735px\">\n<tbody>\n<tr>\n<td style=\"background-color:#fff2cc; width:468.0pt\">\n<p><strong>Wrongful prosecution<\/strong><\/p>\n<ul>\n<li>They are the cases of <strong>miscarriage of justice<\/strong> where procedural misconducts \u2013 police or prosecutorial, malicious or negligent \u2013 resulted in wrongful prosecution of an innocent person, who was ultimately acquitted, with a court making an observation or recording a finding to that effect.<\/li>\n<li>\u00a0The underlying sentiment being that such a person should not have been subjected to these proceedings in the first place.<\/li>\n<\/ul>\n<\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<p><strong>Recommendation of Law commission <\/strong><\/p>\n<p>The Law Commission of India submitted its report titled &#8216;<strong>Wrongful Prosecution (Miscarriage of Justice): Legal Remedies&#8217; to the Government of India on August 30, 2018<\/strong>.<\/p>\n<ul>\n<li>Injustice caused to <strong>innocents needs to be redressed<\/strong> within the<strong> rights framework and not through ex-gratia by the State.<\/strong><\/li>\n<li>The commission recommended setting up a <strong>legal framework to compensate victims prosecuted wrongfully.<\/strong><\/li>\n<li>The commission called for an <strong>established legislative process<\/strong>, <strong>a transparent, uniform,<\/strong> <strong>efficacious, affordable <\/strong>and <strong>timely remedy <\/strong>for the loss and harms inflicted on victims on the account of <strong>wrongful prosecution&#8221;<\/strong>.<\/li>\n<li>The Law Commission in its report called for a<strong> special court in every district.<\/strong><\/li>\n<\/ul>\n","protected":false},"excerpt":{"rendered":"<p>In News A petition has been filed in the Supreme Court highlighting the need for the government to frame guidelines for compensating victims of wrongful prosecution by the police or authorities.
