{"id":14190,"date":"2021-03-03T00:00:00","date_gmt":"2021-03-03T00:00:00","guid":{"rendered":"https:\/\/www.nextias.com\/current_affairs\/uncategorized\/03-03-2021\/extradition\/"},"modified":"2021-03-03T00:00:00","modified_gmt":"2021-03-03T00:00:00","slug":"extradition","status":"publish","type":"post","link":"https:\/\/www.nextias.com\/ca\/current-affairs\/03-03-2021\/extradition","title":{"rendered":"Extradition"},"content":{"rendered":"<p><strong>In News -Recently,<\/strong>the Westminster Magistrate\u2019s Court in London accepted the contention of the Indian government to <strong>extradite Nirav Modi. <\/strong><\/p>\n<ul>\n<li>He duped the <strong>Punjab National Bank of billions of rupees<\/strong> and fled the country .\n<ul>\n<li>The evidence against him \u201cis sufficient to order his <strong>extradition to India<\/strong> to face the charges.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p><strong>About <\/strong><\/p>\n<ul>\n<li><strong>Extradition<\/strong>\n<ul>\n<li>The Supreme Court defined\u00a0 <strong>Extradition as the delivery on the part of one State <\/strong>to <strong>another of those whom<\/strong> it is <strong>desired to deal with for crimes <\/strong>of which they have been a<strong>ccused or convicted and are justifiable in the Courts of the other State<\/strong>.<\/li>\n<li>The Extradition Act 1962 provides <strong>India\u2019s legislative basis for extradition<\/strong>.\n<ul>\n<li>The I<strong>ndian Extradition Act, 1962 was substantially modified in 1993 by Act 66 of 1993.<\/strong><\/li>\n<\/ul>\n<\/li>\n<li><strong>Nodal Authority<\/strong>: CPV Division, of the <strong>Ministry of External Affairs, administers the Extradition Act<\/strong> and <strong>it processes incoming and outgoing Extradition Requests<\/strong>.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p><strong>How is it Implemented?<\/strong><\/p>\n<ul>\n<li>\n<ul>\n<li><strong>Extradition can be initiated<\/strong> in the case of u<strong>nder-investigation, under-trial and convicted criminals. <\/strong><\/li>\n<li>In cases under <strong>investigation, abundant precautions<\/strong> have to be <strong>exercised by the law enforcement agency to ensure<\/strong> that it is in <strong>possession of prima facie<\/strong> evidence to <strong>sustain the allegation before the Courts of Law in the Foreign State.<\/strong><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p><strong>The Extradition Treaty<\/strong><\/p>\n<ul>\n<li><strong>Section 2(d) of The Indian Extradition Act 1962 defines<\/strong> an <strong>\u2018Extradition Treaty\u2019 as a Treaty, <\/strong>Agreement or Arrangement made by India with a <strong>Foreign State,<\/strong> relating to the <strong>extradition of fugitive criminals<\/strong> which <strong>extends to and is binding on, India.<\/strong><\/li>\n<li>Extradition treaties are<strong> traditionally bilateral in character.<\/strong><\/li>\n<li>Generally, there are <strong>five principles<\/strong> which are followed under the<strong> treaty:<\/strong>\n<ul>\n<li>The <strong>extradition applies<\/strong> only to such <strong>offences which are mentioned in the treaty.<\/strong><\/li>\n<li>It applies the <strong>principle of dual criminality<\/strong> which means that the offence <strong>sought to be an offence in the national laws of requesting as well as requested country.<\/strong><\/li>\n<li>The requested <strong>country must be satisfied <\/strong>that there is a <strong>prima facie case made against the offender.<\/strong><\/li>\n<li>The <strong>extradition should be made only for the offence<\/strong> for which extradition was requested.<\/li>\n<li>The <strong>accused must be provided with a fair trial.<\/strong><\/li>\n<\/ul>\n<\/li>\n<li>At present India has an Extradition <strong>treaty with 43 countries and an Extradition agreement with 11 countries.<\/strong><\/li>\n<\/ul>\n<p><a href=\"https:\/\/indianexpress.com\/article\/opinion\/columns\/nirav-modis-extradition-is-a-vindication-of-indias-judicial-system-7211650\/\" target=\"_blank\" rel=\"noopener\"><strong>Source :IE<\/strong><\/a><\/p>\n","protected":false},"excerpt":{"rendered":"<p>In News -Recently,the Westminster Magistrate\u2019s Court in London accepted the contention of the Indian government to extradite Nirav Modi.
