{"id":13958,"date":"2021-02-09T00:00:00","date_gmt":"2021-02-09T00:00:00","guid":{"rendered":"https:\/\/www.nextias.com\/current_affairs\/uncategorized\/09-02-2021\/study-on-economic-impact-of-judicial-decisions\/"},"modified":"2021-02-09T00:00:00","modified_gmt":"2021-02-09T00:00:00","slug":"study-on-economic-impact-of-judicial-decisions","status":"publish","type":"post","link":"https:\/\/www.nextias.com\/ca\/current-affairs\/09-02-2021\/study-on-economic-impact-of-judicial-decisions","title":{"rendered":"Study on \u2018economic impact\u2019 of judicial decisions"},"content":{"rendered":"<p><strong>In News-<\/strong>The NITI Aayog has commissioned a study to examine the \u201c<strong>unintended economic consequences\u201d<\/strong> of<strong> judicial decisions<\/strong> that have hindered projects on environmental grounds.<\/p>\n<p><strong>Why Needed?<\/strong><\/p>\n<ul>\n<li>Judicial decisions have far-reaching <strong>economic impacts<\/strong> which are often not taken into account at the time of<strong> decision making. <\/strong><\/li>\n<li>The absence of<strong> ex-ante analysis <\/strong>of the economic costs associated with a decision is further exacerbated when<strong> judicial activism<\/strong> by <strong>courts and tribunals<\/strong> is in effect.<\/li>\n<\/ul>\n<p><img decoding=\"async\" src=\"https:\/\/cfstatic.nextias.com\/cdn-cgi\/image\/format=auto\/file_library\/mix_content\/513720351888513900_image.png\" style=\"height:325px; margin-left:150px; margin-right:150px; width:320px\" \/><\/p>\n<p><strong>About &#8211;<\/strong><\/p>\n<ul>\n<li>The study is to be undertaken by the J<strong>aipur-headquartered CUTS (Consumer Unity and Trust Society) <\/strong>Centre for <strong>Competition, Investment and Economic Regulation<\/strong>, that also has an international presence.<\/li>\n<li><strong>Purpose <\/strong>&#8211;\n<ul>\n<li>It will examine the <strong>\u201ceconomic impact<\/strong>\u201d of various judgments delivered by the Supreme Court, the high courts, and quasi-judicial bodies such as the National Green Tribunal (NGT) and the \u201cjudicial activism\u201d of such courts and tribunals.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<ul>\n<li><strong>Examination of\u00a0 five major projects<\/strong><\/li>\n<li>It intends to examine five major projects that have been \u201cimpacted\u201d by judicial decisions of the Supreme Court or the National Green Tribunal.\n<ul>\n<li>The first study is on the <strong>economic impact of the ba<\/strong>n that was imposed by the <strong>apex court in March 2019 <\/strong>on the <strong>construction of a greenfield airport at Mopa in Goa. <\/strong>\n<ul>\n<li>The top court had suspended an<strong> economic clearance granted <\/strong>for the airport and had then asked the Expert Appraisal Committee to revisit its decision.<\/li>\n<li>The ban on construction was lifted by an order of the top court in January 2020 but had several revised conditions.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<ul>\n<li>The four other judgments include the <strong>SC\u2019s February 2018 ban<\/strong> on<strong> iron ore mining in Goa<\/strong>, <strong>a 2013 NGT ban on sand mining <\/strong>in the <strong>Yamuna river<\/strong> in <strong>Gautam Buddha Nagar<\/strong>, <strong>the recurring SC ban<\/strong> on construction of buildings in Delhi and <strong>National Capital Region<\/strong> as well as the <strong>apex court\u2019s decision<\/strong> rejecting the opening of <strong>Vedanta\u2019s Sterlite copper plant,<\/strong> which has been closed since April 2018.<\/li>\n<li><strong>Process :<\/strong>\n<ul>\n<li>It plans to do this by interviewing people who&#8217;ve been affected by the closure of the projects, environmental campaigners, experts and assessing the business impact of closure.<\/li>\n<\/ul>\n<\/li>\n<li><strong>\u00a0Objective <\/strong>\n<ul>\n<li>The objective of the study aims a <strong>\u201cnarrative building<\/strong> for <strong>sensitising the judiciary <\/strong>on the <strong>economic impact of their decisions\u201d<\/strong> and the findings will be used as a \u201ctraining input for judges of commercial courts, NGT, HCs, SC.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n","protected":false},"excerpt":{"rendered":"<p>In News-The NITI Aayog has commissioned a study to examine the \u201cunintended economic consequences\u201d of judicial decisions that have hindered projects on environmental grounds.
