Resources<\/strong><\/span><\/span><\/span><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\"> recommended setting up a permanent <\/span><\/span><\/span><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\"><strong>National Integrated Flood Management Group (<\/strong><\/span><\/span><\/span><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\">NIFMG ).\u00a0<\/span><\/span><\/span><\/p>\n<p><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\"><strong><u>About<\/u><\/strong><\/span><\/span><\/span><\/p>\n<ul>\n<li style=\"list-style-type: disc;\"><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\">As <\/span><\/span><\/span><a style=\"text-decoration: none;\" href=\"https:\/\/www.nextias.com\/current-affairs\/14-07-2021\"><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #1155cc;\"><strong><u>frequent floods<\/u><\/strong><\/span><\/span><\/span><u> <\/u><\/a><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\">ravage different parts of the country, a Parliamentary panel has recommended that the Union Government should take up the responsibility of flood management, in the form of a <\/span><\/span><\/span><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\"><strong>National Integrated Flood Management Group<\/strong><\/span><\/span><\/span><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\">, chaired by the Union Minister of Jal Shakti\u00a0<\/span><\/span><\/span><\/li>\n<li style=\"list-style-type: disc;\"><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\">The committee also recommended that chief ministers of the states concerned should be the members of this group and the group should meet at least once a year.<\/span><\/span><\/span><\/li>\n<li style=\"list-style-type: disc;\"><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\">And, States have often demanded natural calamities to be declared as national ones, especially after<\/span><\/span><\/span><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\"><strong> floods in a region<\/strong><\/span><\/span><\/span><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\">.\u00a0<\/span><\/span><\/span><\/li>\n<\/ul>\n<div>\n<table style=\"border-collapse: collapse; border: none; table-layout: fixed; width: 624px;\" cellspacing=\"0\">\n<tbody>\n<tr>\n<td style=\"background-color: #fff2cc; vertical-align: top; border: 1px solid #000000;\"><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\"><strong><u>How does the Law define a Disaster?<\/u><\/strong><\/span><\/span><\/span><\/p>\n<ul>\n<li style=\"list-style-type: disc;\"><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #1155cc;\"><u>\u00a0<\/u><\/span><\/span><\/span><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #1155cc;\"><strong><u>Disaster Management Act, 2005<\/u><\/strong><\/span><\/span><\/span><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\"> defines a \u2018disaster\u2019 as a catastrophe, mishap, calamity or grave occurrence in any area \u2013 arising from <\/span><\/span><\/span><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\"><strong>natural or man-made cause<\/strong><\/span><\/span><\/span><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\">s, or by accident or negligence.\u00a0<\/span><\/span><\/span>\n<ul>\n<li style=\"list-style-type: circle;\"><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\"><strong>A natural disaster <\/strong><\/span><\/span><\/span><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\">includes earthquake, flood, landslide, cyclone, tsunami, urban flood, heatwave; a man-made disaster can be nuclear, biological and chemical.<\/span><\/span><\/span>\n<ul>\n<li style=\"list-style-type: square;\"><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\">It results in substantial loss of life or human suffering or damage to, and destruction of, property, or damage to, or degradation of, environment, and is of such a nature or magnitude as to be beyond the coping capacity of the community of the affected area.\u00a0<\/span><\/span><\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<ul>\n<li style=\"list-style-type: disc;\"><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\"><strong>Disaster management:<\/strong><\/span><\/span><\/span><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\"> It is defined as a<\/span><\/span><\/span><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\"><strong> continuous and integrated process<\/strong><\/span><\/span><\/span><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\"> of <\/span><\/span><\/span><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\"><strong>planning, organising, coordinating<\/strong><\/span><\/span><\/span><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\"> and <\/span><\/span><\/span><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\"><strong>implementing <\/strong><\/span><\/span><\/span><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\">measures necessary to prevent the danger or threat of a disaster, mitigating or reducing the risk of a disaster or its consequences; capacity-building; preparedness to deal with a disaster; and rehabilitation and reconstruction.<\/span><\/span><\/span>\n<ul>\n<li style=\"list-style-type: circle;\"><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\">The <\/span><\/span><\/span><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\"><strong>National Disaster Management Authority (NDMA)<\/strong><\/span><\/span><\/span><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\">, headed by the Prime Minister of India, is the apex body for <\/span><\/span><\/span><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\"><strong>Disaster Management in India.\u00a0<\/strong><\/span><\/span><\/span><\/li>\n<li style=\"list-style-type: circle;\"><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\">Setting up of NDMA and the creation of an enabling environment for institutional mechanisms at the State and District levels is mandated by the <\/span><\/span><\/span><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #1155cc;\"><strong><u>Disaster Management Act, 2005<\/u><\/strong><\/span><\/span><\/span><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\">.<\/span><\/span><\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n<\/div>\n<p><span style=\"font-size: 13pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\"><strong><u>Provisions to\u00a0 Classify a National Calamity<\/u><\/strong><\/span><\/span><\/span><\/p>\n<ul>\n<li style=\"list-style-type: disc;\"><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\">There is no provision, executive or legal, to declare a natural calamity as a national calamity.<\/span><\/span><\/span>\n<ul>\n<li style=\"list-style-type: circle;\"><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\">The existing guidelines of the <\/span><\/span><\/span><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\"><strong>State Disaster Response Fund (SDRF)\/ National Disaster Response Fund (NDRF), <\/strong><\/span><\/span><\/span><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\">do not contemplate declaring a disaster as a \u2018<\/span><\/span><\/span><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\"><strong>National Calamity.\u201d<\/strong><\/span><\/span><\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p><span style=\"font-size: 13pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\"><strong><u>Earlier Attempts in this Direction\u00a0<\/u><\/strong><\/span><\/span><\/span><\/p>\n<ul>\n<li style=\"list-style-type: disc;\"><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\">The 10th Finance Commission (1995-2000) examined a proposal that a disaster is termed \u201ca <\/span><\/span><\/span><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\"><strong>national calamity of rarest severity<\/strong><\/span><\/span><\/span><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\">\u201d if it affects <\/span><\/span><\/span><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\"><strong>one-third of the population<\/strong><\/span><\/span><\/span><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\"> of a state.<\/span><\/span><\/span>\n<ul>\n<li style=\"list-style-type: circle;\"><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\">The panel did not define a \u201cc<\/span><\/span><\/span><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\"><strong>alamity of rare severity\u201d<\/strong><\/span><\/span><\/span><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\"> but stated that a calamity of rare severity would necessarily have to be adjudged on a case-to-case basis taking into account.<\/span><\/span><\/span>\n<ul>\n<li style=\"list-style-type: square;\"><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\"><strong>The intensity and magnitude of the calamity<\/strong><\/span><\/span><\/span><\/li>\n<li style=\"list-style-type: square;\"><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\"><strong>Level of assistance needed<\/strong><\/span><\/span><\/span><\/li>\n<li style=\"list-style-type: square;\"><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\"><strong>The capacity of the state to tackle the problem<\/strong><\/span><\/span><\/span><\/li>\n<li style=\"list-style-type: square;\"><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\"><strong>The alternatives and flexibility were available <\/strong><\/span><\/span><\/span><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\">within the plans to provide succour and relief, etc.\u00a0<\/span><\/span><\/span><\/li>\n<\/ul>\n<\/li>\n<li style=\"list-style-type: circle;\"><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\">In 2001, the<\/span><\/span><\/span><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\"><strong> National Committee on Disaster Management<\/strong><\/span><\/span><\/span><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\"> under the chairmanship of the then Prime Minister was mandated to look into the parameters that should define a national calamity.\u00a0<\/span><\/span><\/span><\/li>\n<li style=\"list-style-type: circle;\"><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\">However, the committee did not suggest any fixed criterion.<\/span><\/span><\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p><span style=\"font-size: 13pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\"><strong><u>Implications of Declaration\u00a0<\/u><\/strong><\/span><\/span><\/span><\/p>\n<ul>\n<li style=\"list-style-type: disc;\"><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\">When a calamity is declared to be of <\/span><\/span><\/span><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\"><strong>\u201crare severity\u201d\/\u201dsevere nature\u201d, <\/strong><\/span><\/span><\/span><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\">support to the state government is provided at <\/span><\/span><\/span><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\"><strong>the national level.<\/strong><\/span><\/span><\/span><\/li>\n<li style=\"list-style-type: disc;\"><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\">\u00a0The Centre also considers additional assistance from the <\/span><\/span><\/span><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\"><strong>NDRF<\/strong><\/span><\/span><\/span><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\">.\u00a0<\/span><\/span><\/span><\/li>\n<li style=\"list-style-type: disc;\"><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\">A Calamity Relief Fund (CRF) is set up, with the corpus shared 3:1 between Centre and state.\u00a0<\/span><\/span><\/span>\n<ul>\n<li style=\"list-style-type: circle;\"><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\">When resources in the CRF are inadequate, additional assistance is considered from the <\/span><\/span><\/span><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\"><strong>National Calamity Contingency Fund (NCCF)<\/strong><\/span><\/span><\/span><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\">, funded 100% by the Centre.\u00a0<\/span><\/span><\/span><\/li>\n<\/ul>\n<\/li>\n<li style=\"list-style-type: disc;\"><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\">Relief in repayment of loans or for grant of fresh loans to the persons affected on concessional terms, too, are considered once a calamity is declared \u201csevere\u201d.<\/span><\/span><\/span><\/li>\n<\/ul>\n<div>\n<table style=\"border-collapse: collapse; border: none; table-layout: fixed; width: 624px;\" cellspacing=\"0\">\n<tbody>\n<tr>\n<td style=\"background-color: #fff2cc; vertical-align: top; border: 1px solid #000000;\"><span style=\"font-size: 13pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\"><strong><u>State Disaster Response Fund (SDRF)<\/u><\/strong><\/span><\/span><\/span><\/p>\n<ul>\n<li style=\"list-style-type: disc;\"><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\">It is constituted under <\/span><\/span><\/span><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\"><strong>Section 48 (1) (a) of the Disaster Management Act, 2005<\/strong><\/span><\/span><\/span><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\">.<\/span><\/span><\/span><\/li>\n<li style=\"list-style-type: disc;\"><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\">It is the <\/span><\/span><\/span><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\"><strong>primary fund<\/strong><\/span><\/span><\/span><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\"> available with State Governments for responses to notified disasters.\u00a0<\/span><\/span><\/span><\/li>\n<li style=\"list-style-type: disc;\"><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\">The Central Government contributes <\/span><\/span><\/span><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\"><strong>75% of SDRF allocation <\/strong><\/span><\/span><\/span><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\">for general category States\/UTs and <\/span><\/span><\/span><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\"><strong>90% for special category States\/UTs<\/strong><\/span><\/span><\/span><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\"> (NE States, Sikkim, Uttarakhand, Himachal Pradesh, Jammu and Kashmir).\u00a0<\/span><\/span><\/span><\/li>\n<li style=\"list-style-type: disc;\"><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\">The annual Central contribution is released in two equal instalments as per the recommendation of the Finance Commission. SDRF shall be used only for meeting the expenditure for providing immediate relief to the victims.<\/span><\/span><\/span><\/li>\n<\/ul>\n<ul>\n<li style=\"list-style-type: disc;\"><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\"><strong>Disaster (s) covered under SDRF:<\/strong><\/span><\/span><\/span><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\"> Cyclone, drought, earthquake, fire, flood, tsunami, hailstorm, landslide, avalanche, cloudburst, pest attack, frost and cold waves.<\/span><\/span><\/span><\/li>\n<\/ul>\n<ul>\n<li style=\"list-style-type: disc;\"><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\"><strong>Local Disaster:<\/strong><\/span><\/span><\/span><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\"> A State Government may use up to<\/span><\/span><\/span><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color:
