panel recommended <\/span><\/span><\/span><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\"><strong>social security measures<\/strong><\/span><\/span><\/span><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\"> for informal workers in its report on the impact of the pandemic on rising unemployment and job loss.<\/span><\/span><\/span><\/p>\n<p><span style=\"font-size: 13pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\"><strong><u>Objectives and Need\u00a0<\/u><\/strong><\/span><\/span><\/span><\/p>\n<ul>\n<li style=\"list-style-type: disc;\"><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\">The pandemic has <\/span><\/span><\/span><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\"><strong>devastated the labour market<\/strong><\/span><\/span><\/span><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\">, denting the employment scenario and threatening the <\/span><\/span><\/span><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\"><strong>survival of millions of workers and their families.<\/strong><\/span><\/span><\/span><\/li>\n<li style=\"list-style-type: disc;\"><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\">The reports noted that 90% of workers were in the informal sector citing the <\/span><\/span><\/span><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #1155cc;\"><u>Periodic Labour Force Survey (PLFS<\/u><\/span><\/span><\/span><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\">).<\/span><\/span><\/span><\/li>\n<li style=\"list-style-type: disc;\"><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\">\u00a0The PLFS quarterly bulletin for April-June 2020 showed the <\/span><\/span><\/span><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\"><strong>unemployment rate<\/strong><\/span><\/span><\/span><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\"> in urban areas for those above<\/span><\/span><\/span><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\"><strong> 15 years at 20.8%, <\/strong><\/span><\/span><\/span><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\">an increase from<\/span><\/span><\/span><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\"><strong> 9.1% in January-March 2020.<\/strong><\/span><\/span><\/span><\/li>\n<li style=\"list-style-type: disc;\"><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\">The COVID-19 crisis in India has come from the backdrop of pre-existing high and rising unemployment.<\/span><\/span><\/span>\n<ul>\n<li style=\"list-style-type: circle;\"><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\">Therefore, a<\/span><\/span><\/span><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\"><strong> comprehensive plan and roadmap<\/strong><\/span><\/span><\/span><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\"> are required to address the <\/span><\/span><\/span><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\"><strong>deteriorating condition of employment<\/strong><\/span><\/span><\/span><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\"> much aggravated by the pandemic, and widening disparities in the job market in the organised sector.<\/span><\/span><\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p><span style=\"font-size: 13pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\"><strong><u>Recommendations \/Suggestions<\/u><\/strong><\/span><\/span><\/span><\/p>\n<ul>\n<li style=\"list-style-type: disc;\"><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\"><strong>The direct transfer of money<\/strong><\/span><\/span><\/span>\n<ul>\n<li style=\"list-style-type: circle;\"><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\">The direct transfer of money into bank accounts of informal workers and an <\/span><\/span><\/span><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\"><strong>urban employment guarantee scheme<\/strong><\/span><\/span><\/span><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\"> is recommended.<\/span><\/span><\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<ul>\n<li style=\"list-style-type: disc;\"><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\">In India, the pandemic had made matters worse for women, the young, self-employed, migrants and workers with low and medium skills.<\/span><\/span><\/span>\n<ul>\n<li style=\"list-style-type: circle;\"><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\">Therefore, the government should <\/span><\/span><\/span><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\"><strong>strive to support a recovery<\/strong><\/span><\/span><\/span><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\"> that is robust, <\/span><\/span><\/span><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\"><strong>broad-based<\/strong><\/span><\/span><\/span><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\"> and <\/span><\/span><\/span><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\"><strong>women-centric<\/strong><\/span><\/span><\/span><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\"> and<\/span><\/span><\/span><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\"><strong> based on social dialogue<\/strong><\/span><\/span><\/span><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\">s with all the stakeholders concerned to promote and ensure a seamless transition.<\/span><\/span><\/span><\/li>\n<\/ul>\n<\/li>\n<li style=\"list-style-type: disc;\"><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\"><strong>Universal healthcare<\/strong><\/span><\/span><\/span><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\"> -It should be made a legal obligation of the government and the budgetary allocation for <\/span><\/span><\/span><a style=\"text-decoration: none;\" href=\"https:\/\/www.nextias.com\/current-affairs\/04-06-2021\/944\"><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #1155cc;\"><u>MGNREGA <\/u><\/span><\/span><\/span><\/a><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\">should be increased.\u00a0<\/span><\/span><\/span>\n<ul>\n<li style=\"list-style-type: circle;\"><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\"><strong>Social Security Code, 2020:<\/strong><\/span><\/span><\/span><\/p>\n<ul>\n<li style=\"list-style-type: disc;\"><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\">It was passed by the Indian Parliament in September 2020 along with three other labour codes, namely<\/span><\/span><\/span>\n<ul>\n<li style=\"list-style-type: circle;\"><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\"><strong>Code on Wages, 2019<\/strong><\/span><\/span><\/span><\/li>\n<li style=\"list-style-type: circle;\"><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\"><strong>Occupational Safety, Health and Working Conditions Code, 2020<\/strong><\/span><\/span><\/span><\/li>\n<li style=\"list-style-type: circle;\"><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\"><strong>Industrial Relations Code, 2020<\/strong><\/span><\/span><\/span>\n<ul>\n<li style=\"list-style-type: square;\"><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\">These are based on recommendations of the Second National Commission on Labour (2002) and amalgamates 29 laws governing minimum wages, occupational safety, social security.<\/span><\/span><\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<\/li>\n<li style=\"list-style-type: disc;\"><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\">It <\/span><\/span><\/span><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\"><strong>amalgamates and rationalises<\/strong><\/span><\/span><\/span><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\"> the provisions of eight existing central labour laws and attempts to include informal workers within the ambit of social security administration.<\/span><\/span><\/span>\n<ul>\n<li style=\"list-style-type: circle;\"><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\">Of these, Employees Provident Fund (EPF), Employees State Insurance (ESI), maternity benefit and gratuity are entirely for organised sector workers.<\/span><\/span><\/span><\/li>\n<\/ul>\n<\/li>\n<li style=\"list-style-type: disc;\"><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\"><strong>Key Features<\/strong><\/span><\/span><\/span>\n<ul>\n<li style=\"list-style-type: circle;\"><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\">The central government can <\/span><\/span><\/span><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\"><strong>apply the Code<\/strong><\/span><\/span><\/span><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\"><strong> \u2018employees\u2019 <\/strong><\/span><\/span><\/span><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\">will include <\/span><\/span><\/span><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\"><strong>contractual labour, gig workers, platform workers, labour from construction sites<\/strong><\/span><\/span><\/span><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\"> and most importantly interstate migrant labour, especially amid the Covid-19 crisis.<\/span><\/span><\/span><\/li>\n<li style=\"list-style-type: circle;\"><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\">Both the central and the state govt will set up <\/span><\/span><\/span><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\"><strong>schemes <\/strong><\/span><\/span><\/span><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\">and a Social Security Fund for unorganized workers.<\/span><\/span><\/span><\/li>\n<li style=\"list-style-type: circle;\"><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\"><strong>The legal framework<\/strong><\/span><\/span><\/span><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\"> implies that the basic onus lies in informal workers registering as beneficiaries.<\/span><\/span><\/span><\/li>\n<li style=\"list-style-type: circle;\"><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\"><strong>Registration is a prerequisite<\/strong><\/span><\/span><\/span><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\"> for <\/span><\/span><\/span><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\"><strong>universal coverage <\/strong><\/span><\/span><\/span><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\">and to avail of social security, an informal worker must register herself on the specified online portal to be developed by the central government.<\/span><\/span><\/span><\/li>\n<li style=\"list-style-type: circle;\"><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\">The code provides for the establishment of a<\/span><\/span><\/span><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\"><strong> national and various state-level boards <\/strong><\/span><\/span><\/span><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\">for administering schemes for<\/span><\/span><\/span><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\"><strong> unorganised sector workers.<\/strong><\/span><\/span><\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\"><strong>Code on Wages, 2019:<\/strong><\/span><\/span><\/span><\/p>\n<ul>\n<li style=\"list-style-type: disc;\"><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\">Amalgamates Payment of Wages Act 1936, Minimum Wages Act 1948, Payment of Bonus Act 1965 and Equal Remuneration Act State governments will make decisions for all other employees.\u00a0<\/span><\/span><\/span><\/li>\n<li style=\"list-style-type: circle;\"><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\">Wages include salary, allowance, or any other component expressed in monetary terms. This does not include bonuses payable to employees or any travelling allowance.<\/span><\/span><\/span><\/li>\n<li style=\"list-style-type: circle;\"><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\">The central government will fix a floor wage, considering the living standards of workers. The central government may obtain the advice of the Central Advisory Board and may consult with state governments.<\/span><\/span><\/span><\/li>\n<li style=\"list-style-type: circle;\"><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\">The Code <\/span><\/span><\/span><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\"><strong>prohibits gender discrimination<\/strong><\/span><\/span><\/span><span style=\"font-size: 11pt;\"><span style=\"font-family: 'Book Antiqua',serif;\"><span style=\"color: #000000;\"> in matters in wages and recruitment of employees for the same work.
