style=\"color:#212121\">Judges continue to remain in office till they reach the age of 65 years in the case of judges of the Supreme Court (<\/span><\/span><\/span><span style=\"font-size:12pt\"><span style=\"font-size:12pt\"><span style=\"font-family:'Book Antiqua',serif\"><span style=\"color:#212121\">The judges are independent as their salaries and allowances are fixed and are not subject to a Antiqua',serif\"><span style=\"color:#212121\"><strong>Powers and Jurisdiction of Supreme Court:<\/strong><\/span><\/span><\/span>\n<ul>\n<li style=\"list-style-type:circle\"><span style=\"font-size:12pt\"><span style=\"font-family:'Book Antiqua',serif\"><span style=\"color:#212121\">Parliament can only add to the powers and jurisdiction of the Supreme Court but cannot curtail to punish any person for their contempt.<\/span><\/span><\/span><\/li>\n<li style=\"list-style-type:circle\"><span style=\"font-size:12pt\"><span style=\"font-family:'Book Antiqua',serif\"><span style=\"color:#212121\">Article 129 provides that the Supreme Court shall have the power to punish for contempt of itself.\u00a0<\/span><\/span><\/span><\/li>\n<li style=\"list-style-type:circle\"><span style=\"font-size:12pt\"><span style=\"font-family:'Book Antiqua',serif\"><span style=\"color:#212121\">Likewise, Art. 215 lays down that every High Court shall Antiqua',serif\"><span style=\"color:#212121\"><strong>Separation of the Judiciary from the Executive:<\/strong><\/span><\/span><\/span>\n<ul>\n<li style=\"list-style-type:circle\"><span style=\"font-size:12pt\"><span style=\"font-family:'Book Antiqua',serif\"><span style=\"color:#212121\">Article 50 states that the state shall take steps to separate the judiciary from the executive style=\"color:#212121\"><strong><u>Need for Independent judiciary<\/u><\/strong><\/span><\/span><\/span><span style=\"font-size:13pt\"><span style=\"font-family:'Book Antiqua',serif\"><span style=\"color:#212121\">\u00a0<\/span><\/span><\/span><\/p>\n<ul>\n<li style=\"list-style-type:disc\"><span style=\"font-size:12pt\"><span style=\"font-family:'Book Antiqua',serif\"><span style=\"color:#212121\"><strong>Welfare State:<\/strong><\/span><\/span><\/span>\n<ul>\n<li style=\"list-style-type:circle\"><span style=\"font-size:12pt\"><span style=\"font-family:'Book style=\"font-family:'Book Antiqua',serif\"><span style=\"color:#212121\"><strong>Live up to people\u2019s aspirations:<\/strong><\/span><\/span><\/span>\n<ul>\n<li style=\"list-style-type:circle\"><span style=\"font-size:12pt\"><span style=\"font-family:'Book Antiqua',serif\"><span style=\"color:#212121\">Judiciary\u2019s ability to uphold the Constitution Antiqua',serif\"><span style=\"color:#212121\"><strong><u>Issues with Judicial Independence<\/u><\/strong><\/span><\/span><\/span><\/p>\n<ul>\n<li style=\"list-style-type:disc\"><span style=\"font-size:12pt\"><span style=\"font-family:'Book Antiqua',serif\"><span style=\"color:#212121\"><strong>Opacity in judge\u2019s appointment:<\/strong><\/span><\/span><\/span>\n<ul>\n<li style=\"list-style-type:circle\"><span style=\"font-size:12pt\"><span style=\"font-family:'Book Antiqua',serif\"><span style=\"color:#212121\">India\u2019s judges have been appointed by a \u201cCollegium\u201d of judges.<\/span><\/span><\/span><\/li>\n<li style=\"list-style-type:circle\"><span style=\"font-size:12pt\"><span style=\"font-family:'Book Antiqua',serif\"><span style=\"color:#212121\">Collegium considers the opinion of the government when appointing judges, but the final decision about who to appoint rests with the style=\"font-family:'Book Antiqua',serif\"><span style=\"color:#212121\">Often, judges who have favours or relationships with senior judges of the Supreme Court or the Executive get promoted to or appointed to more favourable positions.<\/span><\/span><\/span><\/li>\n<\/ul>\n<\/li>\n<li style=\"list-style-type:disc\"><span style=\"font-size:12pt\"><span style=\"font-family:'Book Antiqua',serif\"><span style=\"color:#212121\"><strong>Judicial overreach:<\/strong><\/span><\/span><\/span>\n<ul>\n<li style=\"list-style-type:circle\"><span style=\"font-size:12pt\"><span style=\"font-family:'Book Antiqua',serif\"><span style=\"color:#212121\">Since there is no system of checks on the Supreme Court, it can interfere with the purview of the legislature and
