class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The <strong>State Human Rights Commission (SHRC) is a statutory body <\/strong>in India, established under the provisions of the <strong>Protection of Human Rights Act of 1993.<\/strong>\n<ul class=\"wp-block-list\">\n<li>Thus, it is <strong>not a constitutional body.<\/strong><\/li>\n<\/ul>\n<\/li>\n\n\n\n<li>It serves as the <strong>watchdog of human rights<\/strong> within the State.<\/li>\n\n\n\n<li>It is tasked with <strong>safeguarding rights relating to life, liberty, equality, and dignity<\/strong> of individuals, which are guaranteed by the Constitution of India and embodied in the international covenants.<\/li>\n\n\n\n<li>The Headquarters of the<strong> State Human Rights Commission<\/strong> shall be at such place as <strong>specified by the State Government<\/strong> through official notification.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading has-text-color has-link-color wp-elements-03d25a5c542f24f633a52c303bfcf3d9\" style=\"color:#015aa7\"><span class=\"ez-toc-section\" id=\"What_are_Human_Rights\"><\/span><strong>What are Human Rights?<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<figure class=\"wp-block-table\"><table class=\"has-background\" style=\"background-color:#fff2cc\"><tbody><tr><td>&#8211; As per the <strong>UN definition,<\/strong> \u2018Human rights are those rights that <strong>are inherent to all human beings, regardless of race, sex, nationality, ethnicity, language, religion, or any other status\u2019.<\/strong><br>&#8211; These human rights are <strong>entitled to everyone without any discrimination.<\/strong><br>&#8211; Human rights include the right to life and liberty, freedom from slavery and torture, freedom of opinion and expression, the right to work and education, and many more.<br>&#8211; <strong>Human Rights Day<\/strong> is observed on <strong>10 December <\/strong>every year.<\/td><\/tr><\/tbody><\/table><\/figure>\n\n\n\n<h2 class=\"wp-block-heading has-text-color has-link-color wp-elements-574d102ac3714925b819955eadbc6ef9\" style=\"color:#015aa7\"><span class=\"ez-toc-section\" id=\"Objectives_of_State_Human_Rights_Commission_SHRC\"><\/span><strong>Objectives of State Human Rights Commission (SHRC)<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The specific objectives of the establishment of the State Human Rights Commission (SHRC) are as follows:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>To strengthen the institutional arrangements through which human rights issues could be addressed in their entirety in a more focussed manner,<\/li>\n\n\n\n<li>To look into the allegations of excesses, independently of the government, in a manner that would underline the government&#8217;s commitment to protect human rights,<\/li>\n\n\n\n<li>To complement and strengthen the efforts that have already been made in this direction.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading has-text-color has-link-color wp-elements-937c744f0c11cd17208d0d58ea2cac97\" style=\"color:#015aa7\"><span class=\"ez-toc-section\" id=\"Composition_of_State_Human_Rights_Commission_SHRC\"><\/span><strong>Composition of State Human Rights Commission (SHRC)<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The State Human Rights Commission is a multi\u00b7member body consisting of:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>A Chairperson, and<\/li>\n\n\n\n<li>Two other members.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading has-text-color has-link-color wp-elements-16830712b76acac27fe24de7a2f85d4d\" style=\"color:#015aa7\"><span class=\"ez-toc-section\" id=\"Qualifications_of_Members_of_SHRC\"><\/span><strong>Qualifications of Members of SHRC<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The qualifications of full-time members of the State Human Rights Commission (SHRC) are as follows:<\/p>\n\n\n\n<figure class=\"wp-block-table\"><table class=\"has-background\" style=\"background-color:#fff2cc\"><tbody><tr><td><strong>Chairperson&nbsp;<\/strong><\/td><td>A retired Chief Justice or a Judge of a High Court<\/td><\/tr><tr><td><strong>1st Member<\/strong><\/td><td>A serving or retired Judge of a High Court or a District Judge in the State with a minimum of 7 years experience as a District Judge&nbsp;<\/td><\/tr><tr><td><strong>2nd Member<\/strong><\/td><td>A person having knowledge or practical experience with respect to human rights.&nbsp;<\/td><\/tr><\/tbody><\/table><\/figure>\n\n\n\n<h2 class=\"wp-block-heading has-text-color has-link-color wp-elements-b4ce62057ccfdd8c77b3831d3240c2ca\" style=\"color:#015aa7\"><span class=\"ez-toc-section\" id=\"Appointment_of_Members_of_SHRC\"><\/span><strong>Appointment of Members of SHRC<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The Chairperson and members of the SHRC are appointed by the Governor on the recommendations of a committee consisting of:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The Chief Minister as its head,<\/li>\n\n\n\n<li>The Speaker of the Legislative Assembly,<\/li>\n\n\n\n<li>The Chairperson of the Legislative Council (if it exists),<\/li>\n\n\n\n<li>The Leader of the Opposition in the Legislative Assembly.<\/li>\n\n\n\n<li>The Leader of the Opposition in the Legislative Council (if it exists), and<\/li>\n\n\n\n<li>The State Home Minister<\/li>\n<\/ul>\n\n\n\n<figure class=\"wp-block-table\"><table class=\"has-background\" style=\"background-color:#fff2cc\"><tbody><tr><td><strong>Note<\/strong>:<br>A sitting judge of a High Court or a sitting District Judge can be appointed only after consultation with the Chief Justice of the High Court of the concerned state.<\/td><\/tr><\/tbody><\/table><\/figure>\n\n\n\n<h2 class=\"wp-block-heading has-text-color has-link-color wp-elements-cbf0089a3efcee54e25aaed1844945be\" style=\"color:#015aa7\"><span class=\"ez-toc-section\" id=\"Term_of_Members_of_State_Human_Rights_Commission\"><\/span><strong>Term of Members of State Human Rights Commission<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The Chairperson and the members of SHRC hold office for a term of <strong>3 years<\/strong> or until they attain the <strong>age of 70 years<\/strong>, whichever is earlier.<\/li>\n\n\n\n<li>The Chairperson and other members are <strong>eligible for re-appointment<\/strong> in SHRC.<\/li>\n\n\n\n<li>After their tenure, the Chairperson and the members are <strong>not eligible for further employment<\/strong> under the Central or State Government.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading has-text-color has-link-color wp-elements-651c006c9c5ecee5bed8e41b6b4e73f5\" style=\"color:#015aa7\"><span class=\"ez-toc-section\" id=\"Removal_of_Members_of_SHRC\"><\/span><strong>Removal of Members of SHRC<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Although the Chairperson and the members of a State Human Rights Commission are appointed by the Governor, they can be <strong>removed only by the President.<\/strong><\/li>\n\n\n\n<li>The <strong>manner <\/strong>and <strong>grounds <\/strong>for removal of the chairperson or a member of the SHRC are the <strong>same as those of the<\/strong> chairperson or members of the <strong>NHRC<\/strong>.<\/li>\n\n\n\n<li>Thus, the Chairperson or any member of a SHRC can be removed from the office <strong>if he\/she:<\/strong>\n<ul class=\"wp-block-list\">\n<li>is adjudged insolvent,<\/li>\n\n\n\n<li>engages, during his term of office, in any paid employment outside the duties of his office,<\/li>\n\n\n\n<li>is unfit to continue in office because of the infirmity of mind or body,<\/li>\n\n\n\n<li>is of unsound mind and stands so declared by a competent court,<\/li>\n\n\n\n<li>is convicted and sentenced to imprisonment for an offense.<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li>In addition to these, the President can also remove the Chairperson or any Member on the grounds of <strong>proved misbehavior or incapacity.<\/strong>\n<ul class=\"wp-block-list\">\n<li>However, in these cases, the President has to refer the matter to the Supreme Court for an inquiry.<\/li>\n\n\n\n<li>If the Supreme Court, after the inquiry, upholds the cause of removal and advises so, then the President can remove the Chairperson or a Member of the SHRC.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading has-text-color has-link-color wp-elements-90e088a1ea542e51802681b132cc1fd4\" style=\"color:#015aa7\"><span class=\"ez-toc-section\" id=\"Salaries_and_Service_Conditions_of_Members_of_SHRC\"><\/span><strong>Salaries and Service Conditions of Members of SHRC<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The salaries, allowances, and other conditions of service of the Chairperson or a Member are <strong>determined by the State Government.<\/strong>\n<ul class=\"wp-block-list\">\n<li>They cannot be varied to his\/her disadvantage after his\/her appointment.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading has-text-color has-link-color wp-elements-fd953cb80ee4fb38585ac2b16cf4390d\" style=\"color:#015aa7\"><span class=\"ez-toc-section\" id=\"Jurisdiction_of_SHRC\"><\/span><strong>Jurisdiction of SHRC<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>A State Human Rights Commission can inquire into violation of human rights only in respect of subjects mentioned in the <strong>State List<\/strong> and the <strong>Concurrent List<\/strong> of the Seventh Schedule of the Constitution.\n<ul class=\"wp-block-list\">\n<li><strong>However, if any such case is already being enquired into by the <\/strong>National Human Rights Commission or any other Statutory Commission, then the State Human Rights Commission <strong>does not inquire<\/strong> into that case.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n\n\n\n<figure class=\"wp-block-table\"><table class=\"has-background\" style=\"background-color:#fff2cc\"><tbody><tr><td><strong>Note<\/strong>:<br>The <strong>Central Government may confer upon<\/strong> the State Human Rights Commissions the functions relating to human rights in the <strong>Union Territories, except<\/strong> the UT of <strong>Jammu &amp; Kashmir and Ladakh.<\/strong><br>The functions relating to human rights in the case of <strong>UT of Delhi<\/strong> are to be dealt with by the <strong><a href=\"https:\/\/www.nextias.com\/blog\/national-human-rights-commission-nhrc\/\">National Human Rights Commission<\/a>.<\/strong><\/td><\/tr><\/tbody><\/table><\/figure>\n\n\n\n<h2 class=\"wp-block-heading has-text-color has-link-color wp-elements-37e25e9c6832e1ce77a0770b41d813b8\" style=\"color:#015aa7\"><span class=\"ez-toc-section\" id=\"Functions_of_State_Human_Rights_Commission_SHRC\"><\/span><strong>Functions of State Human Rights Commission<\/strong> <strong>(SHRC)<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The major functions of the State Human Rights Commission (SHRC) are:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>To inquire into any violation of human rights or negligence in the prevention of such violation by a public servant, either suo motu or on a petition presented to it or on an order of a court.<\/li>\n\n\n\n<li>To intervene in any proceeding involving an allegation of violation of human rights pending before a court.<\/li>\n\n\n\n<li>To visit jails and detention places to study the living conditions of inmates and make recommendations thereon.<\/li>\n\n\n\n<li>To review the constitutional and other legal safeguards for the protection of human rights and recommend measures for their effective implementation.<\/li>\n\n\n\n<li>To review the factors including acts of terrorism that inhibit the enjoyment of human rights and recommend remedial measures.<\/li>\n\n\n\n<li>To study treaties and other international instruments on human rights and make recommendations for their effective implementation.<\/li>\n\n\n\n<li>To undertake and promote research in the field of human rights.<\/li>\n\n\n\n<li>To spread human rights literacy among the people and promote awareness of the safeguards available for the protection of these rights.<\/li>\n\n\n\n<li>To encourage the efforts of non-governmental organizations (NGOs) working in the field of human rights.<\/li>\n\n\n\n<li>To undertake such other functions as it may consider necessary for the promotion of human rights.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading has-text-color has-link-color wp-elements-3cebfd824f9abdcb9cd7daee753d5fd0\" style=\"color:#015aa7\"><span class=\"ez-toc-section\" id=\"Powers_of_SHRC\"><\/span><strong>Powers of SHRC<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The SHRC is vested with the <strong>power to regulate its own procedure.<\/strong><\/li>\n\n\n\n<li>It <strong>has all the powers of a Civil Court<\/strong> and its proceedings have a judicial character.<\/li>\n\n\n\n<li>It may call for information or reports from the State Government or any other subordinate authority thereof.<\/li>\n\n\n\n<li>The Commission is <strong>not empowered to inquire<\/strong> into any matter <strong>after the expiry of one year<\/strong> from the date on which the Act constituting a violation of human rights is alleged to have been committed.\n<ul class=\"wp-block-list\">\n<li>In other words, it can look into a matter within one year of its occurrence.<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li>The Commission <strong>may take any of the following steps<\/strong> during or upon the completion of an inquiry:\n<ul class=\"wp-block-list\">\n<li>To recommend to the concerned government or authority to make payment of compensation or damages to the victim.<\/li>\n\n\n\n<li>To recommend to the concerned government or authority the initiation of proceedings for prosecution or any other action against the guilty public servant.<\/li>\n\n\n\n<li>To recommend to the concerned government or authority for the grant of immediate interim relief to the victim.<\/li>\n\n\n\n<li>To approach the Supreme Court or the High Court concerned for the necessary directions, orders, or writs.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading has-text-color has-link-color wp-elements-21012ea1deaf4d914568d76b3a97c1c9\" style=\"color:#015aa7\"><span class=\"ez-toc-section\" id=\"Nature_of_Functions_of_SHRC\"><\/span><strong>Nature of Functions of SHRC<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The functions of the State Human Rights Commission are <strong>mainly recommendatory<\/strong> in nature.\n<ul class=\"wp-block-list\">\n<li>The Commission has <strong>no power to punish<\/strong> the violators of human rights, nor to award any relief including monetary relief to the
