established under the provisions of the <strong>Protection of Human Rights Act of 1993.<\/strong>\n<ul class=\"wp-block-list\">\n<li>Thus, it is <strong>not a <\/strong><a href=\"https:\/\/www.nextias.com\/blog\/constitutional-bodies\/\"><strong>constitutional body<\/strong><\/a><strong>.<\/strong><\/li>\n<\/ul>\n<\/li>\n\n\n\n<li>It serves as the <strong>watchdog of human rights <\/strong>in the country.<\/li>\n\n\n\n<li>It is tasked with safeguarding rights relating to life, liberty, equality, and dignity of individuals, which are guaranteed by the Constitution of India and embodied in the international covenants.<\/li>\n\n\n\n<li>The Headquarters of the National Human Rights Commission is in <strong>New Delhi<\/strong>.\n<ul class=\"wp-block-list\">\n<li>The Commission <strong>can also establish offices <\/strong>in other places in India.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n\n\n\n<figure class=\"wp-block-table\"><table class=\"has-background\" style=\"background-color:#ebecf0\"><tbody><tr><td><strong>What are Human Rights?<br><\/strong><br>&#8211; As per the UN definition, \u2018Human rights are those rights that are <strong>inherent to all human beings, regardless of race, sex, nationality, ethnicity, language, religion, or any other status\u2019.<\/strong><br>&#8211; These human rights are <strong>entitled to everyone without any discrimination.<\/strong><br>&#8211; Human rights include the right to life and liberty, freedom from slavery and torture, freedom of opinion and expression, the right to work and education, and many more.<br>&#8211; <strong>Human Rights Day<\/strong> is observed on <strong>10 December <\/strong>every year.<\/td><\/tr><\/tbody><\/table><\/figure>\n\n\n\n<h2 class=\"wp-block-heading has-text-color has-link-color wp-elements-77adcf8c8aa142faf415c3f97677b4b5\" style=\"color:#015aa7\"><span class=\"ez-toc-section\" id=\"Objectives_of_National_Human_Rights_Commission\"><\/span><strong>Objectives of <strong>National Human Rights Commission<\/strong><\/strong><span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The specific objectives of the establishment of the National Human Rights Commission are as follows:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>To strengthen the institutional arrangements through which human rights issues could be addressed in their entirety in a more focussed manner,<\/li>\n\n\n\n<li>To look into the allegations of excesses, independently of the government, in a manner that would underline the government&#8217;s commitment to protect human rights,<\/li>\n\n\n\n<li>To complement and strengthen the efforts that have already been made in this direction.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading has-text-color has-link-color wp-elements-08ce0905c5a6027880d0712aed039b06\" style=\"color:#015aa7\"><span class=\"ez-toc-section\" id=\"Composition_of_National_Human_Rights_Commission_NHRC\"><\/span><strong>Composition of <strong>National Human Rights Commission<\/strong><\/strong> <strong>(NHRC)<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The commission is a multi-member body consisting of the following <strong>full-time members:<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>A Chairperson, and<\/li>\n\n\n\n<li>5 other members<\/li>\n<\/ul>\n\n\n\n<p>In addition to these full-time members, the commission also has the following <strong>7 ex-officio members:<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Chairperson of the National Commission for Minorities,<\/li>\n\n\n\n<li>Chairperson of the National Commission for SCs,<\/li>\n\n\n\n<li>Chairperson of the National Commission for STs,<\/li>\n\n\n\n<li>Chairperson of the National Commission for Women,<\/li>\n\n\n\n<li>Chairperson of the National Commission for BCs,<\/li>\n\n\n\n<li>Chairperson of the National Commission for the Protection of Child Rights, and<\/li>\n\n\n\n<li>The Chief Commissioner for Persons with Disabilities.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading has-text-color has-link-color wp-elements-9331116686c84aa0199095f32aaecf10\" style=\"color:#015aa7\"><span class=\"ez-toc-section\" id=\"Qualifications_of_Members_of_NHRC\"><\/span><strong>Qualifications of Members of NHRC<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The qualifications of full-time members of the National Human Rights Commission (NHRC) are as follows:<\/p>\n\n\n\n<figure class=\"wp-block-table\"><table class=\"has-background\" style=\"background-color:#ebecf0\"><tbody><tr><td><strong>Chairperson&nbsp;<\/strong><\/td><td>A retired Chief Justice of India or a Judge of the Supreme Court.<\/td><\/tr><tr><td><strong>1st Member<\/strong><\/td><td>A serving or retired Judge of the Supreme Court&nbsp;<\/td><\/tr><tr><td><strong>2nd Member&nbsp;<\/strong><\/td><td>A serving or retired Chief Justice of a High Court<\/td><\/tr><tr><td><strong>3rd, 4th and 5th Member<\/strong><\/td><td>Persons having knowledge or practical experience with respect to human rights.&nbsp;<br><strong>Note: <\/strong>Out of these three members, <strong>one should be a woman.&nbsp;<\/strong><\/td><\/tr><\/tbody><\/table><\/figure>\n\n\n\n<h2 class=\"wp-block-heading has-text-color has-link-color wp-elements-3633faa76219d4463727bcf81c37c475\" style=\"color:#015aa7\"><span class=\"ez-toc-section\" id=\"Appointment_of_Members_of_National_Human_Rights_Commission\"><\/span><strong>Appointment of Members of National Human Rights Commission<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The Chairperson and the members of the National Human Rights Commission are appointed by the President on the recommendations of a six-member committee consisting of:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The Prime Minister as its head,<\/li>\n\n\n\n<li>The Speaker of the Lok Sabha,<\/li>\n\n\n\n<li>The Deputy Chairman of the Rajya Sabha,<\/li>\n\n\n\n<li>The Leader of the Opposition in the Lok Sabha,<\/li>\n\n\n\n<li>The Leader of the Opposition in the Rajya Sabha, and<\/li>\n\n\n\n<li>The Union Home Minister,<\/li>\n<\/ul>\n\n\n\n<figure class=\"wp-block-table\"><table class=\"has-background\" style=\"background-color:#ebecf0\"><tbody><tr><td><strong>Note<\/strong>: A sitting judge of the Supreme Court or a sitting Chief Justice of a High Court can be appointed only after consultation with the Chief Justice of India.<\/td><\/tr><\/tbody><\/table><\/figure>\n\n\n\n<h2 class=\"wp-block-heading has-text-color has-link-color wp-elements-8829fda311a735c46a0a0f040e7d5738\" style=\"color:#015aa7\"><span class=\"ez-toc-section\" id=\"Term_of_Members_of_National_Human_Rights_Commission\"><\/span><strong>Term of Members of National Human Rights Commission<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The Chairperson and the members of NHRC hold office for a term of <strong>3 years<\/strong> or until they attain the <strong>age of 70 years,<\/strong> whichever is earlier.<\/li>\n\n\n\n<li>The Chairperson and other members are <strong>eligible for re-appointment<\/strong> in NHRC.<\/li>\n\n\n\n<li>After their tenure, the Chairperson and the members are <strong>not eligible for further employment<\/strong> under the Central or State Government.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading has-text-color has-link-color wp-elements-c90212561ea78ef45621ddbd7814271e\" style=\"color:#015aa7\"><span class=\"ez-toc-section\" id=\"Removal_of_Members_of_NHRC\"><\/span><strong>Removal of Members of NHRC<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The President can remove the Chairperson or any member from the office if he\/she:\n<ul class=\"wp-block-list\">\n<li>is adjudged insolvent,<\/li>\n\n\n\n<li>engages, during his term of office, in any paid employment outside the duties of his office,<\/li>\n\n\n\n<li>is unfit to continue in office because of the infirmity of mind or body,<\/li>\n\n\n\n<li>is of unsound mind and stands so declared by a competent court,<\/li>\n\n\n\n<li>is convicted and sentenced to imprisonment for an offence.<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li>The President can also remove the Chairperson or any Member on the grounds of <strong>proved misbehaviour or incapacity.<\/strong>\n<ul class=\"wp-block-list\">\n<li>However, in these cases, the President has to <strong>refer the matter to the Supreme Court<\/strong> for an inquiry.<\/li>\n\n\n\n<li>If the Supreme Court, after the inquiry, upholds the cause of removal and advises so, then the President can remove the Chairperson or a member of NHRC.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading has-text-color has-link-color wp-elements-ce756dc336276e07bf2a99c00505640e\" style=\"color:#015aa7\"><span class=\"ez-toc-section\" id=\"Salaries_and_Service_Conditions_of_Members_of_NHRC\"><\/span><strong>Salaries and Service Conditions of Members of NHRC<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The salaries, allowances, and other conditions of service of the Chairperson or a member are <strong>determined by the Central Government.<\/strong>\n<ul class=\"wp-block-list\">\n<li>They cannot be varied to his\/her disadvantage after his\/her appointment.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading has-text-color has-link-color wp-elements-9e773cae9417b3f277ad0bc662b893c1\" style=\"color:#015aa7\"><span class=\"ez-toc-section\" id=\"Functions_of_the_NHRC\"><\/span><strong>Functions of the NHRC<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The major functions of the National Human Rights Commission (NHRC) are:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>To inquire into any violation of human rights or negligence in the prevention of such violation by a public servant, either suo motu or on a petition presented to it or on an order of a court.<\/li>\n\n\n\n<li>To intervene in any proceeding involving an allegation of violation of human rights pending before a court.<\/li>\n\n\n\n<li>To visit jails and detention places to study the living conditions of inmates and make recommendations thereon.<\/li>\n\n\n\n<li>To review the constitutional and other legal safeguards for the protection of human rights and recommend measures for their effective implementation.<\/li>\n\n\n\n<li>To review the factors including acts of terrorism that inhibit the enjoyment of human rights and recommend remedial measures.<\/li>\n\n\n\n<li>To study treaties and other international instruments on human rights and make recommendations for their effective implementation.<\/li>\n\n\n\n<li>To undertake and promote research in the field of human rights.<\/li>\n\n\n\n<li>To spread human rights literacy among the people and promote awareness of the safeguards available for the protection of these rights.<\/li>\n\n\n\n<li>To encourage the efforts of non-governmental organizations (NGOs) working in the field of human rights.<\/li>\n\n\n\n<li>To undertake such other functions as it may consider necessary for the promotion of human rights.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading has-text-color has-link-color wp-elements-aab77bb51516297b46a5eb69e6424f44\" style=\"color:#015aa7\"><span class=\"ez-toc-section\" id=\"Working_of_National_Human_Rights_Commission\"><\/span><strong>Working of National Human Rights Commission<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The commission has its own nucleus of investigating staff for investigation into complaints of human rights violations.<\/li>\n\n\n\n<li>It can also utilize the services of any officer or investigation agency of the Central or any state government for investigating purposes.<\/li>\n\n\n\n<li>The Commission has also established effective cooperation with the NGOs to receive first-hand information about human rights violations.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading has-text-color has-link-color wp-elements-a7a9cfd3f7ee5ca06a65dafeed88821f\" style=\"color:#015aa7\"><span class=\"ez-toc-section\" id=\"Powers_of_NHRC\"><\/span><strong>Powers of NHRC<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The NHRC is vested with the <strong>power to regulate its own procedure.<\/strong><\/li>\n\n\n\n<li>It <strong>has all the powers of a Civil Court<\/strong> and its proceedings have a judicial character.<\/li>\n\n\n\n<li>It may call for information or reports from the Central and State Governments or any other subordinate authority thereof.<\/li>\n\n\n\n<li>The Commission is <strong>not empowered to inquire<\/strong> into any matter <strong>after the expiry of one year<\/strong> from the date on which the Act constituting a violation of human rights is alleged to have been committed.\n<ul class=\"wp-block-list\">\n<li>In other words, it can look into a matter within one year of its occurrence.<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li>The Commission <strong>may take any of the following steps<\/strong> during or upon the completion of an inquiry:\n<ul class=\"wp-block-list\">\n<li>To recommend to the concerned government or authority to make payment of compensation or damages to the victim.<\/li>\n\n\n\n<li>To recommend to the concerned government or authority the initiation of proceedings for prosecution or any other action against the guilty public servant.<\/li>\n\n\n\n<li>To recommend to the concerned government or authority for the grant of immediate interim relief to the victim.<\/li>\n\n\n\n<li>To approach the Supreme Court or the High Court concerned for the necessary directions, orders, or writs.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading has-text-color has-link-color
