decision-making body responsible for formulating policies, rules, and regulations governing the GST system in the country.<\/li>\n\n\n\n<li>The <strong>Secretariat of the Goods and Services Tax<\/strong> <strong>Council<\/strong> is located in <strong>New Delhi.<\/strong><\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading has-text-color has-link-color (GST)<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<figure class=\"wp-block-table\"><table class=\"has-background\" style=\"background-color:#ebecf0\"><tbody><tr><td>&#8211; Goods and Services Tax is an <strong>indirect tax <\/strong>levied in India <strong>on <\/strong>the <strong>supply of goods and services.<\/strong><br>&#8211; It is a <strong>value-added tax<\/strong> levied on most goods and services sold for domestic consumption.<br>&#8211; It was <strong>launched in India in 2017<\/strong> as a comprehensive indirect tax for the entire country.<br>&#8211; It is a comprehensive, multistage, destination-based tax because it has subsumed almost all the indirect taxes except a few state taxes.<br>&#8211; It is paid by the consumers and is remitted to the government by the businesses selling the goods and services.<br>&#8211; It is of <strong>three types<\/strong>:<br>a. CGST is to be levied by the Centre,<br>b. SGST is to be levied by the States and<br>c. IGST is a tax levied on all Inter-State supplies of goods and\/or services.<br>&#8211; All these taxes are levied at <strong>rates mutually agreed upon by the Centre and the States.<\/strong><br>&#8211; The GST Council is the governing and key decision-making body for GST.<\/td><\/tr><\/tbody><\/table><\/figure>\n\n\n\n<h2 class=\"wp-block-heading has-text-color has-link-color wp-elements-95b17485815ae806c56a2cecb61c940d\" style=\"color:#015aa7\"><span class=\"ez-toc-section\" id=\"Constitutional_Provisions_related_to_GST_Council\"><\/span><strong>Constitutional Provisions related to GST Council<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The <strong>101st Amendment Act of 2016 <\/strong>paved the way for the introduction of a new tax regime, that is, <strong>Goods and Services Tax (GST) <\/strong>in the country.<\/li>\n\n\n\n<li>This Amendment Act inserted a new Article 279-A in the Constitution, which empowers the President to constitute a Goods and Services Tax Council or the Goods and Services Tax Council by an order.\n<ul class=\"wp-block-list\">\n<li>Accordingly, the President issued the order in 2016 and constituted the Goods and Services Tax Council.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading has-text-color has-link-color wp-elements-7499ce58482c6979e50697135f071263\" style=\"color:#015aa7\"><span class=\"ez-toc-section\" id=\"Vision_of_Goods_and_Services_Tax_Council\"><\/span><strong>Vision of Goods and Services Tax<\/strong> <strong>Council<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>As the first constitutional federal body vested with powers to take all major decisions related to GST, the Goods and Services Tax aims to establish the highest standards of the cooperative federation in the functioning of the Council.<\/p>\n\n\n\n<h2 class=\"wp-block-heading has-text-color has-link-color wp-elements-2b378b5deb0601b45f150c14509e756b\" style=\"color:#015aa7\"><span class=\"ez-toc-section\" id=\"Mission_of_GST_Council\"><\/span><strong>Mission of GST Council<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The Mission of the Goods and Services Tax Council is to use a process of wider consultation to evolve a GST Structure, which is Information Technology-driven and user-friendly.<\/p>\n\n\n\n<h2 class=\"wp-block-heading has-text-color has-link-color wp-elements-99e086345cf9c9fa8e434b0a140720c1\" style=\"color:#015aa7\"><span class=\"ez-toc-section\" id=\"Composition_of_the_GST_Council\"><\/span><strong>Composition of the GST Council<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>As a joint forum of the Center and the States, the GST Council consists of the following members:<\/p>\n\n\n\n<figure class=\"wp-block-table\"><table class=\"has-background\" style=\"background-color:#ebecf0\"><tbody><tr><td><strong>Chairperson<\/strong><\/td><td>&#8211; The Union Finance Minister<\/td><\/tr><tr><td><strong>Vice -Chairperson<\/strong><\/td><td>&#8211; The Members of the Goods and Services Tax Council from the States have to choose one amongst themselves as the Vice-Chairperson of the Council.<br>&#8211; The members can also decide their term.<\/td><\/tr><tr><td><strong>Members<\/strong><\/td><td>&#8211; The Union Minister of State in charge of Revenue or Finance.<br>&#8211; The Ministers in charge of Finance or Taxation or any other Minister nominated by the State Government.<\/td><\/tr><tr><td><\/td><td>&#8211; The Chairperson of the Central Board of Indirect Taxes and Customs (CBlC) is a permanent invitee (non-voting) to all proceedings of the Goods and Services Tax Council.<\/td><\/tr><tr><td><\/td><td>&#8211; The Union Revenue Secretary (Department of Revenue, Ministry of Finance) acts as the ex-officio Secretary to the Goods and Services Tax Council.<\/td><\/tr><\/tbody><\/table><\/figure>\n\n\n\n<h2 class=\"wp-block-heading has-text-color has-link-color wp-elements-d067de90343ef76dc5f463b392ef7523\" style=\"color:#015aa7\"><span class=\"ez-toc-section\" id=\"Working_of_the_GST_Council\"><\/span><strong>Working of the GST Council<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The GST Council takes every decision at its meetings by a majority of not less than three-fourths of the weighted votes of the members present and voting.\n<ul class=\"wp-block-list\">\n<li>The least quorum required for conducting a meeting is 50% of the total number of members of the Council.<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li>The weights of the votes are calculated as follows:\n<ul class=\"wp-block-list\">\n<li>Weightage of Center\u2019s Vote: The vote of the Central Government is assigned a weightage of one-third of the total votes cast in a particular meeting.<\/li>\n\n\n\n<li>Weightage of States\u2019 Votes: The votes of all the state governments combined is assigned a weightage of two-thirds of the total votes cast in a particular meeting.<\/li>\n\n\n\n<li>Any proceedings or acts of the GST Council will not become invalid on the following grounds:<\/li>\n\n\n\n<li>Any defect or vacancy in the constitution of the GST Council,<\/li>\n\n\n\n<li>Any defect in the appointment of any member of the GST Council,<\/li>\n\n\n\n<li>Any procedural irregularity of the GST Council does not affect the merits of the case.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading has-text-color has-link-color wp-elements-99a51e32465fcb16df0ff59fde0c4525\" style=\"color:#015aa7\"><span class=\"ez-toc-section\" id=\"Functions_of_the_GST_Council\"><\/span><strong>Functions of the GST Council<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The GST Council is required to make recommendations to the Centre and the States on the following matters:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The taxes, cesses, and surcharges levied by the Center, the States, and the local bodies would get subsumed into GST.<\/li>\n\n\n\n<li>The goods and services that may be subjected to or exempted from GST.<\/li>\n\n\n\n<li>The model GST Laws, principles of levy, apportionment of GST levied on supplies in the course of inter-state trade or commerce, and the principles that govern the place of supply.<\/li>\n\n\n\n<li>The threshold limit of turnover below which goods and services may be exempted from GST.<\/li>\n\n\n\n<li>The rates include the floor rates with bands of GST.<\/li>\n\n\n\n<li>Any special rate or rates for a specified period to raise additional resources during any natural calamity or disaster.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading has-text-color has-link-color wp-elements-629a83a0a05a2f0b0b416bcf63516ddf\" style=\"color:#015aa7\"><span class=\"ez-toc-section\" id=\"Other_Functions_of_the_GST_Council\"><\/span><strong>Other Functions of the GST Council<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Recommending the date on which the GST may be levied on petroleum crude, high-speed diesel, motor spirit (petrol), natural gas, and aviation turbine fuel.<\/li>\n\n\n\n<li>Establishing a mechanism to adjudicate upon the dispute:\n<ul class=\"wp-block-list\">\n<li>between the Center and one or more States,<\/li>\n\n\n\n<li>between the Center and any State or States on one side and one or more other States on the other side,<\/li>\n\n\n\n<li>between two or more States.<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li>Recommending compensation to the States for the loss of revenue arising on account of the introduction of GST for five years.\n<ul class=\"wp-block-list\">\n<li>The Parliament determines the compensation based on these recommendations.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading has-text-color has-link-color wp-elements-d0adc4bd9eb2e9b9b187dc32f0e06642\" style=\"color:#015aa7\"><span class=\"ez-toc-section\" id=\"Conclusion\"><\/span><strong>Conclusion<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>The Goods and Services Tax (GST) Council stands as a testament to India&#8217;s commitment to fostering cooperative federalism and streamlining its indirect tax regime.
