class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The <strong>Election Commission of India (ECI)<\/strong> is a permanent and independent established by the Constitution of India <strong>to ensure free and fair <\/strong>elections in the country.\n<ul class=\"wp-block-list\">\n<li>Since it is established directly under the provisions of the Constitution, it is a <strong>Constitutional Body.<\/strong><\/li>\n<\/ul>\n<\/li>\n\n\n\n<li>The ECI is an <strong>All-India body<\/strong> in the sense that it is <strong>common <\/strong>to both the <strong>Central <\/strong>and the <strong>State <\/strong>governments.<\/li>\n\n\n\n<li>The Constitution vests the <strong>Election Commission of India (ECI)<\/strong> with the power of superintendence, direction, and control of elections to\n<ul class=\"wp-block-list\">\n<li><strong>Parliament <\/strong>&#8211; Lok Sabha and Rajya Sabha<\/li>\n\n\n\n<li><strong>State Legislatures<\/strong> &#8211; State Legislative Assembly and State Legislative Council (if exist)<\/li>\n\n\n\n<li>Office of <strong>President of India<\/strong><\/li>\n\n\n\n<li>Office of <strong>Vice-President of India<\/strong><\/li>\n<\/ul>\n<\/li>\n\n\n\n<li>It is to be noted that the ECI is <strong>not concerned with conducting <\/strong>elections to <strong>Panchayats <\/strong>and <strong>Municipalities <\/strong>in the States.\n<ul class=\"wp-block-list\">\n<li>For this purpose, the Constitution of India provides for a separate <strong>State Election Commission<\/strong> in each State.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading has-text-color has-link-color wp-elements-165c8016aeb720a064f8c45075ea7372\" style=\"color:#015aa7\"><span class=\"ez-toc-section\" id=\"Constitutional_Provisions_related_to_the_Election_Commission_of_India_ECI\"><\/span><strong>Constitutional Provisions related to the Election Commission of India (ECI)<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Article 324<\/strong> of the Constitution of India deals with the provisions related to the <strong>Election Commission of India (ECI).<\/strong>\n<ul class=\"wp-block-list\">\n<li>The article contains detailed provisions regarding the composition of the ECI, appointment and service conditions of its members, powers and functions of the ECI, and other related aspects.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading has-text-color has-link-color wp-elements-4d4b3c258054af1ac36b83c6cab09e44\" style=\"color:#015aa7\"><span class=\"ez-toc-section\" id=\"Composition_of_Election_Commission_of_India\"><\/span><strong>Composition of Election Commission of India<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p><strong>Article 324 of the Constitution<\/strong> has made the following provisions about the composition of the Election Commission of India:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>It shall consist of the <strong>Chief Election Commissioner (CEC) <\/strong>and <strong>such number of other Election Commissioners (ECs)<\/strong> as the <strong>President <\/strong>may from time to time fix.<\/li>\n\n\n\n<li>The <strong>appointment of CEC and other ECs<\/strong> shall be made by the <strong>President<\/strong>.<\/li>\n\n\n\n<li>When any other Election Commissioner is so appointed, the <strong>Chief Election<\/strong> <strong>Commissioner <\/strong>shall act as the Chairman of the ECI.<\/li>\n\n\n\n<li>The President may also appoint after consultation with the ECI such <strong>Regional Commissioners (RCs)<\/strong> as he may consider necessary to assist the ECI.<\/li>\n\n\n\n<li>The <strong>conditions of service<\/strong> and <strong>tenure of office<\/strong> of the <strong>Election Commissioners and the Regional Commissioners<\/strong> shall be determined by the <strong>President <\/strong>(subject to any related law made by the Parliament).<\/li>\n<\/ul>\n\n\n\n<figure class=\"wp-block-table\"><table class=\"has-background\" style=\"background-color:#fff2cc\"><tbody><tr><td><strong>Note:<\/strong> At present, the Election Commission of India consists of a <strong>Chief Election Commissioner<\/strong> and <strong>two Election Commissioners.<\/strong><\/td><\/tr><\/tbody><\/table><\/figure>\n\n\n\n<h2 class=\"wp-block-heading has-text-color has-link-color wp-elements-d34651b3bf238cb21e322e86cbf3097d\" style=\"color:#015aa7\"><span class=\"ez-toc-section\" id=\"Appointment_of_Members_of_ECI\"><\/span><strong>Appointment of Members of ECI<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>As per the <strong>Chief Election Commissioner and other Other Election Commissioners (Appointment, Conditions of Service and Term of Office) Act, 2023,<\/strong> the Chief Election Commissioner and the Election Commissioners are appointed by the President of India on the recommendation of a three-membered <strong>Selection Committee<\/strong> consisting of:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The Prime Minister of India<\/li>\n\n\n\n<li>A Union Minister nominated by the Prime Minister<\/li>\n\n\n\n<li>The Leader of Opposition (LoP) in the Lok Sabha<\/li>\n<\/ul>\n\n\n\n<p>A <strong>Search Committee headed by the Cabinet Secretary<\/strong> suggests five names to the Selection Committee. The Selection Committee is not bound to these name suggestions and may consider any person other than those suggested by the Search Committee. It is to be noted that the <strong>process of appointment<\/strong> of the Chief Election Commissioner and the Election Commissioners has <strong>changed recently in 2023. Before<\/strong> this, they were appointed by the President <strong>on the recommendation of the Union CoM.<\/strong><\/p>\n\n\n\n<h2 class=\"wp-block-heading has-text-color has-link-color wp-elements-c8171b21526668d5ee261246799111ae\" style=\"color:#015aa7\"><span class=\"ez-toc-section\" id=\"Term_of_Members_of_ECI\"><\/span><strong>Term of Members of ECI<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>According to the <strong>Election Commission (Conditions of Service of Election Commissioners and Transaction of Business) Act, 1991,<\/strong> the Chief Election Commissioner and the Election Commissioners hold office for a <strong>term <\/strong>of <strong>6 years<\/strong> or <strong>until <\/strong>they attain the <strong>age of 65 years, <\/strong>whichever is earlier.<\/p>\n\n\n\n<h2 class=\"wp-block-heading has-text-color has-link-color wp-elements-9823a8b394e8cfe0700b9a0fd5cf3f17\" style=\"color:#015aa7\"><span class=\"ez-toc-section\" id=\"Resignation_of_Members_of_ECI\"><\/span><strong>Resignation of Members of ECI<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>According to the <strong>Election Commission<\/strong> <strong>(Conditions of Service of Election Commissioners and Transaction of Business) Act, 1991,<\/strong> the Chief Election Commissioner and the Election Commissioners can <strong>resign <\/strong>at any time <strong>by writing to the President.<\/strong><\/p>\n\n\n\n<h2 class=\"wp-block-heading has-text-color has-link-color wp-elements-1956b60ea9df5a85be6fe575dad477c2\" style=\"color:#015aa7\"><span class=\"ez-toc-section\" id=\"Removal_of_Members_of_ECI\"><\/span><strong>Removal of Members of ECI<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<h3 class=\"wp-block-heading has-text-color has-link-color wp-elements-28ee6e80e9b64d3b281daa117ffbdfb7\" style=\"color:#ff6a00\"><span class=\"ez-toc-section\" id=\"Removal_of_the_Chief_Election_Commissioner\"><\/span><strong>Removal of the Chief Election Commissioner<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li>The Chief Election Commissioner can be removed in the same manner and on the same grounds <strong>as a judge of the Supreme Court.<\/strong>\n<ul class=\"wp-block-list\">\n<li>In other words, he\/she can be removed by the President on the basis of a resolution passed to that effect by both Houses of Parliament with a <strong>Special Majority,<\/strong> either on the grounds of <strong>proved misbehaviour or incapacity.<\/strong><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading has-text-color has-link-color wp-elements-886ac3c75eecbd91f3cd99525410c452\" style=\"color:#ff6a00\"><span class=\"ez-toc-section\" id=\"Removal_of_Election_Commissioner_and_Regional_Commissioners\"><\/span><strong>Removal of Election Commissioner and Regional Commissioners<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Any other Election Commissioner or a Regional Commissioner is removed from office <strong>on the recommendation of the Chief Election Commissioner.<\/strong>\n<ul class=\"wp-block-list\">\n<li>Thus, the protection of security of tenure, which is available to the Chief Election Commissioner, is not available to the other Election Commissioners.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading has-text-color has-link-color wp-elements-058171a9b14d0b51c5415010ac1b8643\" style=\"color:#015aa7\"><span class=\"ez-toc-section\" id=\"Salary_and_Allowances_of_the_Members_of_the_ECI\"><\/span><strong>Salary and Allowances of the Members of the ECI<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>According to the <strong>Election Commission (Conditions of Service of Election Commissioners and Transaction of Business) Act, 1991,<\/strong> the Chief Election Commissioner (CEC) and two Election Commissioners (ECs) receive equal salaries, allowances, and other prerequisites that are <strong>similar to <\/strong>those of the <strong>judge of the Supreme Court.<\/strong><\/p>\n\n\n\n<h2 class=\"wp-block-heading has-text-color has-link-color wp-elements-a13f79388c6901422b9b6ddb8117d61d\" style=\"color:#015aa7\"><span class=\"ez-toc-section\" id=\"The_Chief_Election_Commissioner_Vis-a-vis_Election_Commissioners\"><\/span><strong>The Chief Election Commissioner Vis-a-vis Election Commissioners<\/strong><span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p>As per the <strong>Election Commission (Conditions of Service of Election Commissioners and Transaction of Business) Act,
